Meeting of the Lincoln County Board of Commissioners. Present were Commissioners
Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White,
Deputy County Attorney, Joe Wright and County Clerk, Rebecca Rossell. Deterding
offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for
public review and the County Board will comply with the open meeting requirements.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Commissioners meeting held on March 1, 2010. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to receive and order filed the
Treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to receive and order filed the fee reports
submitted by the County Clerk, County Treasurer, Clerk of District Court and County
Court. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,
none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln
County Board of Equalization convened.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor, Mary Ann Long appeared.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Equalization meeting held on March 1, 2010. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to authorize the Chairman to sign the
certificates of correction and refund as submitted by the County Assessor. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to approve the tax exemption
application on real and personal property submitted by Birthline. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to disallow the tax exemption
application for real and personal property submitted by Overland Trails Council – Boy
Scouts as it was sold to a non tax exempt entity. Upon roll call vote Deterding,
Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion By Deterding, seconded by Roethemeyer to offer a Confession of Judgment
regarding the case of Larry D. Warwick, Appellant, v. Lincoln County Board of
Equalization, Appelle, Case No. 09C-158, which is before the Nebraska Tax
Equalization and Review Commission, in which the Lincoln County Board of
Equalization confesses the value of the real estate in said herein motion to be $115,015
(Land – $10,500 and Improvements – $104,515) for the tax year 2009. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to offer a Confession of Judgment
regarding the case of Providence Investments II, LLC, Appellant, v. Lincoln County
Board of Equalization, Appellee, Case No. 09C-119, which is before the Nebraska Tax
Equalization and Review Commission, in which the Lincoln County Board of
Equalization confesses the value of the real estate in said herein motion to be $151,515
(Land – $151,515 and Improvements $00.00) for tax year 2009. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:28 A.M. and the Lincoln
County Board of Commissioners reconvened.
Brady Village Clerk, Pam Diehl and Brady Village Board Member, Jeff Miller appeared
to request the county to reinstate the interlocal agreement for police services.
Motion by Deterding, seconded by Roethemeyer to enter the County of Lincoln into a
written agreement with the Village of Brady to reinstate the Interlocal Agreement for
Police Services which was to terminate by mutual agreement of the parties on March
31, 2010. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,
none.
Randy Saner, Extension Educator Unit Leader, gave a brief update on the move that
will be occurring on March 15th and 16th of their offices to the West Central Research
and Extension Center. The phone number will remain the same.
Lonnie Folchert of District 11 Probation commented that they are very pleased with their
new building and that the energy efficient systems put into the building have worked
well. He asked the board to consider replacing the old windows in the future as they are
not energy efficient. There are a total of 14 windows.
Deputy County Attorney, Joe Wright, reported that he had contacted Tim Brouillette
about representing the county on two tax foreclosure complaints because of a conflict of
interest.
Motion by Deterding, seconded by Roethemeyer to appoint Tim Brouillette to represent
the County of Lincoln and the Clerk of the District Court for Lincoln County as judgment
creditors on Case Nos. CI10-53 and CI10-55. Upon roll call vote Deterding,
Roethemeyer and Hewgley voted “aye”. Nays, none.
County Planning Director, Judy Clark and Deputy County Attorney, Joe Wright informed
board members that the planning commission has drafted an amendment to the Lincoln
County Zoning Regulations regarding wind energy conversion systems for them to
review for their comments.
Commissioner Hewgley asked about migratory birds.
Clark replied there is a set back away from public conservation areas in the draft.
Commissioner Deterding commented that his questions concerning roads, color of the
blades and repair/replacement of the units had been addressed in the draft.
Commissioner Roethemeyer asked for some clarification in the amendment on the
definition of windmill and the old wind chargers already in use.
Clark responded that a clarification of the definition of windmill could be addressed and
the any systems currently being used to generate wind energy would be grandfathered.
She anticipates a public hearing before the planning commission in April, 2010.
Commissioner Hewgley questioned how wind farms would be addressed.
Clark commented that they would be obtained through a conditional use permit.
Wright reported that the planning commission was still having conversation concerning
the use of small wind energy conversion systems on less than 10 acres tracts.
Kirk Nichols (Construction Project Inspector/Owners Representative) gave the County
Commissioners a construction update on the Lincoln County Jail Project.

The meeting was adjourned at 10:47 A.M.
Advance notice and the agenda for the March 8, 2010 board meetings were sent to
members of the County Board, County Attorney and all others requesting the same.
Notice was posted at the Lincoln County Courthouse, City Hall and on the county
website.
The agenda for the meetings to be held on Monday, March 15, 2010 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk.
The regular meeting of the Lincoln County Board of Commissioners will be held at the
Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular
meeting of the Lincoln County Board of Equalization will be held at the Lincoln County
Courthouse in the Commissioners Room at 9:15 A.M.
