Meeting of the Lincoln County Board of Commissioners. Present were Commissioners
Joe Hewgley, Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White,
Deputy County Attorney, Joe Wright, and County Clerk, Rebecca Rossell. Hewgley
offered prayer. Chairman Hewgley called the meeting to order at 9:02 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for
public review and the County Board will comply with the open meeting requirements.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Commissioners meeting held on March 15, 2010. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to receive and order filed the
treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to receive and order filed the fee report
submitted by the County Sheriff. Upon roll call vote Deterding, Roethemeyer and
Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to authorize the Chairman to sign the
City/County Lottery Renewal Applications for 2010-2012 as submitted. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln
County Board of Equalization convened.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor, Mary Ann Long and Deputy County Assessor, Julie Stenger
appeared.
Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the
Lincoln County Board of Equalization meeting held on March 15, 2010. Upon roll call
vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to authorize the Chairman to sign the
certificates of correction and refund as submitted by the County Assessor. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to approve the tax exemption
application submitted by Lincoln County Community Services on real and personal
property as submitted. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln
County Board of Commissioners reconvened.
JoAnne Hoatson, representing the Golden Spike Visitors Center told board members
that she was requesting the special designated permit to host the Chamber of
Commerce business after hour’s event for the month of April.
Bob Pederson spoke in opposition of the permit as the Golden Spike Visitors Center
was granted tax exemption status last year for educational purposes.
Sheriff Kramer commented that he had no problems with event and that it was no
different than the Lincoln County Fair Board or NebraskaLand Days requesting a permit.
Motion by Deterding, seconded by Roethemeyer to approve the special designated
liquor permit for the Golden Spike Tower and Visitors Center for an event to be held on
April 16, 2010 at the Golden Spike Tower.
Commissioner Hewgley related that in the past they have only denied those applications
that did not meet application requirements.
Commissioner Deterding commented that he knew this event was hosted monthly in
different locations.
Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Deputy County Attorney, Joe Wright reported that a public meeting had been held prior
concerning the amendments to the Lincoln County General Assistance Program
Regulations/Standards. The changes discussed were opening/closing costs for burials
and possible addition of language for those individuals who were denied. Changing the
opening/closing costs is the only amendment before the County Board today.
Motion by Deterding, seconded by Roethemeyer to adopt and approve the proposed
amendments to the current Lincoln County General Assistance Program
Regulations/Standards as previously entered into between the County Board of Lincoln
County, Nebraska and the Nebraska Department of Health & Human Services. Upon
roll call vote Deterding, Roethemeyer and Hewgley voted “aye.” Nays, none.
Jerry Hitchcock, Highway Supt., Carla O’Dell, Assistant Highway Supt. and County
Board members discussed advertising and accepting bids in the future for scrap iron but
will take action on the current agenda items.
Motion by Roethemeyer, seconded by Deterding to declare the county’s scrap iron in
the Lincoln County Road Department to be surplus property, which is obsolete or not
usable by the county. Upon roll call vote Deterding, Roethemeyer and Hewgley voted
“aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to place a value of $600.00 on the
surplus property (scrap iron) located at the Lincoln County Road Department. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to sell the surplus property (scrap iron)
to Arthur Saathoff for $600.00. Upon roll call vote Deterding, Roethemeyer and
Hewgley voted “aye”. Nays, none.
The following bids were received for one used bucket truck for the Lincoln County
Department of Roads:
Mountain Truck & Equipment Company $26,950.00
Northern Truck Equipment Corp. $48,600.00
Motion by Deterding, seconded by Roethemeyer to accept the low bid of Mountain
Truck & Equipment Company in the amount of $26,950.00. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Roethemeyer to adopt Resolution No. 2010-07 to
sign a project program agreement with the State of Nebraska Department of Roads
regarding statewide fracture critical bridge inspections in Lincoln County, NE. Upon roll
call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Deterding to take the county’s contract amount
from the above stated agreement from the county’s soft match credits to pay the
county’s share to Nebraska Department of Roads. Upon roll call vote Deterding,
Roethemeyer and Hewgley voted “aye”. Nays, none.
Kirk Nichols (Construction Project Inspector/Owners Representative) gave the County
Board a construction update on the Lincoln County Jail project.
Motion by Deterding, seconded by Roethemeyer to go into closed session at 10:49 A.M.
on personnel matters for the prevention of needless injury to the reputation of an
individual and the individual did not request a public hearing. Upon roll call vote
Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
Chairman Hewgley restated the reason for the closed session.
Motion by Roethemeyer, seconded by Deterding to go into open session at 12:02 P.M.
Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.
No action was taken following the closed session.
Approved the claims presented for payment.
The meeting was adjourned at 12:14 P.M.
Advance notice and the agenda for the March 22, 2010 board meetings were sent to
members of the County Board, County Attorney and all others requesting the same.
Notice was posted at the Lincoln County Courthouse, City Hall and on the county
website.
The agenda for the meetings to be held on Monday, March 29, 2010 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk.
The regular meeting of the Lincoln County Board of Commissioners will be held at the
Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular
meeting of the Lincoln County Board of Equalization will be held at the Lincoln County
Courthouse in the Commissioners Room at 9:15 A.M.
