Meeting of the Lincoln County Board of Commissioners. Present were Commissioners

Duane Deterding, Willis Roethemeyer, Joe Hewgley, Board Assistant, Tammy White,

Deputy County Attorney, Joe Wright and County Clerk, Rebecca Rossell. Hewgley

offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments if posted for

public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Roethemeyer to approve the minutes regarding the

Lincoln County Board of Commissioners meeting held on June 7, 2010. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the

treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted

“aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to receive and order filed the fee

reports submitted by the Clerk of District Court, Register of Deeds and the County

Sheriff. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

Motion by Deterding, seconded by Roethemeyer to approve and authorize the chairman

to sign the right of way application submitted by Qwest. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to approve the substitution of

securities by Hershey State Bank as pledged to the Lincoln County Treasurer. Upon

roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to enter into an interlocal agreement

with the Village of Brady concerning the Lincoln County Department of Roads graveling

and grading gravel streets within the village limits of Brady and authorize the chairman

to sign. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln

County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Treasurer, Sue Fleck and County Assessor, Mary Ann Long appeared.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the

Lincoln County Board of Equalization meeting held on June 7, 2010. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to authorize the chairman to sign the

certificates of correction and refund as submitted by the County Assessor. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve the motor vehicle tax

exemption applications submitted by Great Plains Regional Medical Center, North Platte

Catholic Schools, and North Platte Opportunity Center. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to approve the motor vehicle tax

exemption applications submitted by Berean Fundamental Church, Boy Scout Troop

#81 and First Baptist Church. Upon roll call vote Deterding, Roethemeyer and Hewgley

voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve the notice of valuation

changes as submitted by the County Assessor numbered 2010-14 thru 2010-43. Upon

roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:26 A.M. and the Lincoln

County Board of Commissioners reconvened.

Michael Hiatt appeared to respond to any questions concerning the application by

Leonard Hiatt for approval of Hiatt Administrative Subdivision located in an A-1

Agricultural District at 9425 West Hwy 30, North Platte, NE described as part of the SW

¼ SE ¼ of Section 21; Township 14 North, Range 31 West of the 6th P.M., Lincoln

County, Nebraska.

The review comments of the planning commission were read and stated they had no

objections to the subdivision.

Motion by Deterding, seconded by Roethemeyer to approve File No. SU10-002 Hiatt

Administrative Subdivision. Upon roll call vote Deterding, Roethemeyer and Hewgley

voted “aye”. Nays, none.

Gwendolyn Johnson, Michelle McFarland- advocate for Ms. Johnson, Dawn Anderson

and Keri Miller representing DHHS were present to discuss the general assistance

appeal filed by Johnson.

All those above concerning the appeal were sworn in for testimony by Chairman

Hewgley.

DHHS presented evidence explaining the process and why the application was denied.

Gwendolyn stated that she had no questions concerning the evidence submitted by

DHHS except that she had been struggling working 15 hours and had cut back her

hours.

Keri Miller reported that her employer had cut her back to 7 hours at her request.

Michelle McFarland, commented that she had been working at her employment and

was being monitored by Goodwill Industries and was unable to maintain the 15 hour

schedule.

Commissioner Hewgley questioned if Voc Rehab and Goodwill Industries were paying

positions.

Gwendolyn replied no, that they helped her find work.

Motion by Deterding, seconded by Roethemeyer to go into closed session at 9:58 A.M.

to protect the reputation of an individual. Upon roll call vote Deterding, Roethemeyer

and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Roethemeyer to go into open session at 10:23 A.M.

Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

This item was recessed until 10:45 A.M. in regard to the general assistance appeal filed

by Gwendolyn Johnson to allow her to obtain and submit additional documentation.

Motion by Roethemeyer, seconded by Deterding to enter into Addendum #2 – For

Cooperative Reimbursement Agreement for Child Support Services with the State of

Nebraska Department of Health and Human Services concerning the state email

system. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

Kirk Nichols (Construction Project Inspector/Owners Representative) and Carol Rouw of

Treanor Architects (appearing by phone) gave the county board a construction update

on the Lincoln County Jail Project.

Michelle McFarland presented further confidential hospital information concerning the

appeal of Gwendolyn Johnson which was marked by the County Clerk as Exhibit #4.

No action was taken on the appeal at this time.

Approved the following claims presented for payment:

The meeting was adjourned at 11:20 A.M.

Advance notice and the agenda for the June 14, 2010 board meetings were sent to the

county board, county attorney and all others requesting the same. Notice was posted at

the Lincoln County Courthouse, City Hall and on the county website.

The agenda for the meetings to be held on Monday, June 21, 2010 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.

The regular meeting of the Lincoln County Board of Commissioners will be held at the

Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular

meeting of the Lincoln County Board of Equalization will be held at the Lincoln County

Courthouse in the Commissioners Room at 9:15 A.M.
