Meeting of the Lincoln County Board of Commissioners. Present were Commissioners

Joe Hewgley, Duane Deterding, Willis Roethemeyer, Deputy County Attorney, Joe

Wright and Deputy County Clerk, Terry Heessel. Deterding offered prayer. Chairman

Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

public review and the county board will comply with the open meeting requirements.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the

Lincoln County Board of Commissioners meeting held on July 19, 2010. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the

treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted

“aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the Condition

of the Treasury of Lincoln County, NE from January 1, 2010 to June 30, 2010. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to adopt Resolution No. 2010-15

directing the County Treasurer to issue tax sale certificates on those parcels which

there are two years delinquent real estate taxes or assessments. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to authorize the chairman to sign the

right of way application submitted by Peterson Drilling. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to authorize the chairman to sign a

letter of engagement with Susan Maline, CPA for budget assistance. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to authorize the chairman to sign the

2010 Crime Commission Enhancement Grant for Community Connections. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Recessed as the Lincoln County Board of Commissioners and convened as the Lincoln

County Board of Equalization at 9:19 A.M.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the

Lincoln County Board of Equalization meeting held on July 19, 2010. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

No certificates of correction and refund were submitted by the County Assessor. M

Motion by Deterding, seconded by Roethemeyer to approve the notice of valuation

changes numbered 2010-292 thru 2010-327 as submitted by the County Assessor.

Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

A letter of protest was received from William and Sandra Pratt for sending in an

application for homestead exemption late. As per County Assessor, Mary Ann Long

and Dixie Gallaway an application for homestead exemption has never been received.

Both documents needed to be received by the County Assessor’s office by July 20,

2010.

Motion by Deterding, seconded by Roethemeyer to deny homestead exemption to

William and Sandra Pratt as all documentation was not received by the deadline. Upon

roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Personal property protests 2010-3PP and 2010-4PP submitted by General Electric

Capitol Corp. was withdrawn.

Motion by Deterding, seconded by Roethemeyer to approve the tax exemption

application submitted by Quail Creek Cemetery Services & Associates. Upon roll call

vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Adjourned as the Lincoln County Board of Equalization at 9:45 A.M. and the Lincoln

County Board of Commissioners reconvened.

Quarterly report by Veterans Service Officer, Paul Cooper.

Motion by Deterding, seconded by Roethemeyer to accept and order filed with the

Lincoln County Register of Deeds Office the following conveyance to Lincoln County,

NE and give authority to the Chairman of the Lincoln County Board of Commissioners to

sign the Real Estate Transfer Statement regarding the following conveyance: A)

Warranty Deed from Ryan Docter, a single person, dated June 17, 2010, regarding a

parcel of land lying in Section 33, Township 14 North, Range 31 West of the 6th P.M., in

the County of Lincoln, Nebraska, and containing 0.28 acres or 12,407.14 square feet,

more or less. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”.

Nays, none.

Kirk Nichols (Construction Project Inspector/Owners Representative) gave the board a

construction update on the Lincoln County Jail Project.

Approved the following claims presented for payment:

The Lincoln County Board of Commissioners adjourned at 10:47 A.M.

Advance notice and the agenda for the July 26, 2010 board meetings were sent to

members of the county board, county attorney and all others requesting the same.

Notice was posted at the Lincoln County Courthouse, City Hall and on the county

website.

The agenda for the meetings to be held on August 2, 2010 will be kept continually

current and open for inspection at the office of the Lincoln County Clerk. The regular

meeting of the Lincoln County Board of Commissioners will be held at the Lincoln

County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of

the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse

in the Commissioners Room at 9:15 A.M.
