Meeting of the Lincoln County Board of Commissioners. Present were Commissioners

Joe Hewgley, Duane Deterding, Board Assistant, Tammy White, Deputy County

Attorney, Joe Wright and County Clerk, Rebecca Rossell. Commissioner Roethemeyer

was absent. Hewgley offered prayer. Chairman Hewgley called the meeting to order at

9:03 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

public review and the County Board will comply with the open meeting requirements.

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the

Lincoln County Board of Commissioners meeting held on August 30, 2010. Upon roll

call vote Deterding and Hewgley voted “aye”. Nays, none. Roethemeyer absent.

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s

receipts. Upon roll call vote Deterding and Hewgley voted “aye”. Nays, none.

Roethemeyer absent.

Motion by Deterding, seconded by Hewgley to approve and authorize the chairman to

sign the Equitable Sharing Agreement and Certification to the U.S. Dept. of Justice for

the County Attorney’s office. Upon roll call vote Deterding and Hewgley voted “aye”.

Nays, none. Roethemeyer absent.

Motion by Deterding, seconded by Hewgley to receive and order filed the fee reports

submitted by the Clerk of District Court, County Clerk and County Treasurer. Upon roll

call vote Deterding and Hewgley voted “aye”. Nays, none. Roethemeyer absent.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln

County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for

County Assessor, Mary Ann Long and Deputy County Assessor, Julie Stenger was

present.

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the

Lincoln County Board of Equalization meeting held on August 30, 2010. Upon roll call

vote Deterding and Hewgley voted “aye”. Nays, none. Roethemeyer absent.

Motion by Deterding, seconded by Hewgley to authorize the chairman to sign the

certificates of correction and refund as submitted by the County Assessor. Upon roll

call vote Deterding and Hewgley voted “aye”. Nays, none. Roethemeyer absent.

Carol Bender appeared concerning her protest of denial of homestead exemption

application.

Deputy County Assessor, Julie Stenger, reported to the board that the Dr. denied her

application and she was sent a rejection notice. She had 30 days to protest it, which

she has done. She went back to her Dr. and he gave her a written letter stating she did

qualify for the exemption. They contacted the State of Nebraska and were told that at

the County Board’s discretion they could allow her to re-submit the form back to the Dr.

Commissioner Deterding questioned if she played on any pool leagues.

Bender replied that she plays on two pool leagues and plays twice a week.

Motion by Deterding, seconded by Hewgley to continue the protest of denial of

homestead exemption application of Carol Bender until September 20, 2010 at 9:15

A.M. Upon roll call vote Deterding and Hewgley voted “aye”. Nays, none.

Roethemeyer absent.

Mr. Cervantez did not appear at the meeting.

Motion by Deterding, seconded by Hewgley to continue the protest of denial of

homestead exemption application of John Cervantez until September 20, 2010 at 9:15

A.M. Upon roll call vote Deterding and Hewgley voted “aye”. Nays, none.

Roethemeyer absent.

The Lincoln County Board of Equalization adjourned at 9:28 A.M. and the Lincoln

County Board of Commissioners reconvened.

Kirk Nichols (Construction Project Manager/Owners Representative) gave a

construction update of the Lincoln County Jail Project.

Approved the following claims presented for payment:

The meeting was adjourned at 9:55 A.M.

Advance notice and the agenda for the September 7, 2010 board meetings were sent to

members of the County Board, County Attorney and all others requesting the same.

Notice was posted at the Lincoln County Courthouse, City Hall and on the county

website.

The agenda for the meetings to be held on September 13, 2010 will be kept continually

current and open for inspection at the office of the Lincoln County Clerk. The regular

meeting of the Lincoln County Board of Commissioners will be held at the Lincoln

County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of

the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse

in the Commissioners’ Room at 9:15 A.M.
