Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell and board assistant, Tammy White.  Roethemeyer offered prayer.  Chairman Deterding called the meeting to order at 9:02 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the County Board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Roethemeyer to approve minutes regarding the Lincoln County Board of Commissioners meeting held on July 5, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the fee reports submitted by Clerk of District Court, County Treasurer, County Sheriff and Register of Deeds.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the special designated liquor permit submitted by Butch’s Inc. for an event to be held at the Girl Scout Cabin on August 13, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the addition of securities by Farmers State Bank as pledged to the County Treasurer.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the right of way application submitted by Source Gas.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:19 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger, was present.

 

Motion by Hewgley, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 5, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to authorize the Chairman to sign the certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the notice of valuation changes numbered 2011-041 thru 2011-045 as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

A public hearing was opened at 9:30 A.M. to receive comments on the appointment of Robert McChesney to Hospital Authority No. 1 of Lincoln County Board of Directors for a six year term to expire September, 2017.

 

Mike Feagler, interim chief financial officer for Great Plains Regional Medical Center appeared to explain the purpose of the hospital authority and to ask for the appointment of Robert McChesney.  Orville Kaschke asked to not be reappointed for another term.  The hospital authority is needed for bonds and the hospital has the sole liability of the bonds.

 

The public hearing was closed at 9:35 A.M.

 

Motion by Hewgley, seconded by Roethemeyer to adopt Resolution No. 2011-23 to appoint Robert McChesney for a six year term to expire September, 2017 to the Hospital Authority No. 1 of Lincoln County Board of Directors.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 10:08 A.M. and the Lincoln County Board of Equalization reconvened.

 

Discussed and consider property valuation protests that were filed on real property.

 

The Lincoln County Board of Equalization adjourned at 11:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Roethemeyer to add an emergency item to the agenda to discuss conditions at the new Lincoln County Detention Center concerning public safety issues.

 

Dan Rowe of Treanor Architects was contacted by telephone.

 

Kirk Nichols, Owners Representative, reported that drains in 9 locations are not draining water and that an immediate response is needed to correct this situation.

 

Rowe commented that he had received and email from Greg Lockwood of Roche Contractors stating that they had gotten permission from Carol of Treanor Architects to install minimal sweep or flat drains rather than what the specifications called for.

 

Dan reported that he had to talked to Carol and she states this did not occur.

 

Kirk related that the water needs to be dammed up so it does get into the drying area.

 

Rowe suggested a rubber dam or stop around the areas until the floors can be removed.  The slab will have to be cut out and replaced and he realized that it needed to be done before an incident occurred.  The architect stated that Treanor Architects will pay for the remedial work if the contractor does not.

 

Commissioner Hewgley asked Rowe to line up personnel to get this taken care of in the next 24 hours.

 

Rowe requested assistance from Kirk Nichols to supply the names of contractors in this area that could remedy this situation quickly and he will send specifications on the rubber dam item to be used temporarily.

 

Commissioner Hewgley asked about the additional expense that might be incurred due to having to move prisoners out of the cells blocks to do this type of remedial work.

 

Nichols also reported that there are still several areas where water is still coming in on the walls.

 

Commissioner Hewgley asked that all these activities by coordinated while we are moving prisoners around.

 

Rowe questioned if it might be possible to move prisoners within the jail so they could work on one day room at a time.  He will begin working with Kirk to find a contractor to replace the floors.

 

Sheriff Kramer commented that they can probably move most classifications within the facility but several areas might be a problem.

 

Nichols again discussed the area that is leaking due to issues with the exhaust fan.

 

Rowe stated that Treanor Architects will pay for the remedial work to solve the exhaust fan issue.

Advance notice and the agenda for the July 11, 2011 board meetings were sent to members of the County Board, County Attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on July 18, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
