Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell, Deputy County Attorney, Joe Wright and Board Assistant, Tammy White.  Hewgley offered prayer.  Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the County Board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 8, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the fee reports submitted by the Register of Deeds and County Sheriff.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Recess at 9:15 A.M. as the Lincoln County Board of Commissioners and convene as the Lincoln County Board of Equalization.

County Assessor, Julie Stenger, was present.

 

Motion by Hewgley, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 8, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the Notice of Valuation changes numbered 2011-63 thru 2011-66 as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Adjourn at 9:17 A.M. as the Lincoln County Board of Equalization and reconvene as the Lincoln County Board of Commissioners.

 

Lincoln County Planning Administrator, Judy Clark, appeared to present application File No. SU11-002 by Benjamin and Ashly Margritz for approval of Jeffrey Fjords First Replat located at 19915 Sea Street, Brady, NE (Jeffrey Lake) described as Tract A and Lot 2 of Jeffrey Fjords Estate II, Lincoln County, NE.  The applicant is dividing a portion of the current lot off and selling it to his neighbor.  The Planning Commission approved the application.

 

Motion by Hewgley, seconded by Roethemeyer to approve File No. SU11-002 as presented.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to reappoint Kurt Pieper, Steve Koch and Rod Christmann to the Lincoln County Planning Commission for three year terms.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to reappoint Jon McNeel and Frank Fleecs to the Lincoln County Board of Adjustment for three year terms.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to set September 12, 2011 at 10:00 A.M. as a time for public hearing to receive comments on the proposed 2011/2012 fiscal year Lincoln County, NE budget.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve exceeding the budget limit by an additional 1% for the 2011/2012 fiscal year Lincoln County, NE budget.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve special designated liquor permits submitted by Chef LaLanne LLC for events to be held at the Lincoln County Fairgrounds on September 3, 2011 and September 24, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to authorize the chairman to sign the real estate transfer statement and accept the Warranty Deed from Dawson County Public Power District dated August 9, 2011, regarding a parcel of land lying in Section 29, Township 14 North, Range 31 West of the 6th P.M., Lincoln County, NE, and containing 0.12 acres, more or less.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to authorize the chairman to sign the real estate transfer statement and accept the Control Ingress and Egress Quitclaim Deed from Dawson County Public Power District dated August 9, 2011, regarding a parcel of land lying in Section 29, Township 14 North, Range 31 West of the 6th P.M., Lincoln County, Nebraska.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Roric Paulman addressed the County Board concerning road matters. He stated that harvest will start in the next 30 days and that he is disappointed in the poor condition of the roads.  He would like to be part of a solution to maintain and update the infrastructure in Lincoln County.

 

Commissioner Deterding commented that he realized there are issues and the lack of barrow pits in some areas may be a contributing factor.

 

Commissioner Hewgley recommended that we identify the problem areas and potential solutions to fix the problems.  He also voiced that we have gone backwards in funding.

 

Commissioner Roethemeyer thanked Mr. Paulman for coming to the meeting as Ag business is a high priority as well.

 

Jerry Hitchcock, Lincoln County Highway Supt., stated that at the next focus group meeting there is going to be discussion concerning corridors in this area of the county.

 

Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:31 A.M. to discuss a personnel matter to prevent the needless injury to the reputation of an individual.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Roethemeyer, seconded by Hewgley to go into open session at 10:50 A.M.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Deputy County Attorney stated for the record that he had talked to the individual this session was pertaining to and he requested that it be held in closed session.

 

A budget work session was conducted.

 

The Lincoln County Board of Commissioners recessed at 12:42 P.M. and reconvened at 1:34 P.M.

Advance notice and the agenda for the August 15, 2011 board meetings were sent to the County Board, County Attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on August 22, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
