Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell and County Board Assistant, Tammy White.  Hewgley offered prayer.  Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the County Board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 29, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the fee report submitted by the County Clerk.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Recess at 9:15 A.M. as the Lincoln County Board of Commissioners and reconvene as the Lincoln County Board of Equalization.

County Assessor, Julie Stenger was present.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 29, 2011.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the notice of valuation change numbered 2011-076 as submitted by the County Assessor.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Adjourn at 9:18 A.M. as the Lincoln County Board of Equalization and reconvene as the Lincoln County Board of Commissioners.

 

Sheriff Kramer presented proceeds in the amount of $3725 to Bridge of Hope Advocacy Center, Rape & Domestic Abuse Program and Community Domestic Violence Intervention Program from the Lincoln County Sheriff’s Office and Detention Center fundraiser.

 

Motion by Hewgley, seconded by Roethemeyer to approve the “Deed of Correction – Control of Ingress and Egress” signed by Arline Kumor concerning Tract 3 of Project RRZ-1390(3), Control No. 61416, regarding project commonly known as Front Road Grade Separation and give authority to the Chairman of the Lincoln County Board of Commissioners to sign such “Deed of Correction – Control of Ingress and Egress” and also authority to sign the Real Estate Transfer Statement regarding such “Deed of Correction – Control of Ingress and Egress.”  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to authorize the Chairman to sign a letter to the Nebraska Emergency Management Agency appointing Jerry Hitchcock, Lincoln County Highway Superintendent (RC), as the authorized representative for Lincoln County for the federally declared disaster #4013.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Lincoln County Highway Supt., Jerry Hitchcock, commented on the volunteer workers to assist the road department.  He stated that these volunteers would be incident specific and will always be accompanied by road department personnel.

 

Motion by Roethemeyer, seconded by Hewgley to give the Lincoln County Highway Superintendent authority to have volunteer workers assist and/or work with the Lincoln County Department of Roads, if such volunteer worker signs an “Agreement Assuming Risk of Injury or Damage Waiver and Release of Claims and Indemnity Agreement” that is approved by the Lincoln County Attorney or one of his/her deputies.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to go into closed session at 10:01 A.M. for strategy session concerning collective bargaining with F.O.P. Lodge #26.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Roethemeyer, seconded by Hewgley to go into open session at 11:18 A.M.   Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

 

Approved the following claims presented for payment:

Advance notice and the agenda for the September 6, 2011 board meetings were sent to members of the county board, county attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on September 12, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
