North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners.  Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell and County Board Assistant, Tammy White.  Hewgley offered prayer.  Chairman Roethemeyer called the meeting to order at 9:05 A.M.

 

Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 9, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to appoint Jack Gier, Building and Grounds Director, to the Lincoln County Safety Committee from January 30, 2012 through June 18, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to authorize the Chairman to sign an agreement with Snell Services for the Lincoln County Courthouse Electrical Upgrade.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the fee reports submitted by the Treasurer, Register of Deeds and Sheriff.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the substitution of securities by Hershey State Bank as pledged to the County Treasurer.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2012-05 to transfer $12,000 from the Misc. Budget to the Unemployment Security Budget within the General Fund.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger was present.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 9, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Deterding to set Tuesday, February 21, 2012 at 10:00 A.M. for public hearing on the One & Six Year Road Plan for Lincoln County, Nebraska.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Deputy County Attorney, Joe Wright arrived at 9:30 A.M.

 

Mavis Slack and counsel, Stephen Potter, appeared to discuss a tort claim that was filed for damages to real property caused by flooding.

 

Jerry Hitchcock, Lincoln County Highway Supt., reported that NPPD had put in a pipe several years ago for seepage to drain and that it runs into a NPPD drainage ditch.  There was 6 – 9 inches of rain that fell in several hours which caused the flooding to occur.

 

Potter also disclosed that he filed a claim on behalf of Mavis Slack with NPPD.  He also commented that the county road department has an old culvert in this area but also installed a new one.

 

Ms. Slack reported that historically water has never come into that area until the new culvert was installed.  Her home was underwater for two weeks and it was six weeks before it finally drained.

 

Commissioner Hewgley stated that Hitchcock had taken photos and shown them to the Commissioners at that time.

 

NPPD did consult with the county after this incident and the road department did tear out several driveways according to Hitchcock.

 

Motion by Hewgley, seconded by Deterding to acknowledge the tort claim filed by Mavis Slack.   Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to appoint Paul Cooper as Veterans Service Officer at an annual salary of $35,750.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to appoint Jerry Hitchcock as Lincoln County Highway Supt. at an annual salary of $51,000.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to appoint Rod Yost as Noxious Weed Supt. at an annual salary of $38,000.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the special designated liquor permit submitted by Golden Spike Tower and Visitors Center for an event to be held on February 14, 2012 at the Golden Spike Tower.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the chairman to sign and initial the date correction a contract with the State of Nebraska Dept. of Economic Development Community Development Block Grant Contract No. 10-ED-003 (involving a special economic development activity with Greenbrier Rail Services as the benefited business and with West Central Nebraska Development District as the nonprofit development organization carrying out CDBG-assisted activity(ies) on behalf of The county of Lincoln, Nebraska.) [CFDA #14-228].  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.

Motion by Deterding, seconded by Hewgley to approve the special designated liquor permit submitted by Dawn Sampeck dba Curtis Cattle Co. for an event to be held on February 4, 2012 at the Lincoln County Ag Building.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Jayna Schaff, Executive Director of Community Connections, told the board that the 2012 grant application is basically the same with one exception.  She added the CASA program to the application and deleted Keep North Platte/Lincoln County Beautiful as they pursuing other grant opportunities.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the chairman to sign the Nebraska Crime Commission 2012 State County Aid Juvenile Justice Grant Application as presented.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the chairman to sign the Nebraska Crime Commission 2012 County Aid Enhancement Juvenile Justice Grant Application as presented.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Deputy County Attorney, Joe Wright, arrived at 11:00 A.M.

 

Paul Grieger of D.A. Davidson reported that things were looking good for Lincoln County to refinance the 2009 series bonds.  The estimated savings would be $630,254.96 if they can get it done.  He presented a parameters resolution if the county board is interested in proceeding with refinancing.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2012-06 which is a parameters resolution to refinance the 2009 bonds and authorize the board chairman and county clerk to sign where applicable.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Deputy County Attorney, Joe Wright, was excused at 11:20 A.M.

 

Motion by Hewgley, seconded by Deterding to reappoint Dr. Trent States as the Dental Advisor to the West Central Health Department District Board for a three year term to expire January, 2015 and to reappoint County Commissioner, Willis Roethemeyer.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to appoint Dr. Sarah Schaffer to fill the vacancy of the spirited individual which will expire January, 2014.  Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”.  Nays, none.

Advance notice and the agenda for the January 17, 2012 board meetings were sent to members of the county board, county attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on January 23, 2012 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
