Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Duane Deterding and Willis Roethemeyer, County Clerk, Rebecca Rossell, Deputy County Attorney, Joe Wright and Board Assistant, Tammy White. Hewgley offered prayer. Chairman Roethemeyer called the meeting to order at 9:00 A.M.
Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting on February 27, 2012. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2012-10 for policy and procedure concerning federal tax law and disclosure requirements for tax-exempt bonds and/or Build America Bonds and appointing the County Clerk as compliance officer. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to receive and order filed the fee reports submitted by the County Sheriff. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman, County Clerk and County Treasurer to sign the proper closing documents associated with the General Obligation Refunding Bonds, Series 2012 which include the treasurer’s receipt, closing certificate, certificate showing compliance with requirements to public meeting law, IRS Form 8038-G, certificate with respect to tax matters, paying agent agreement and escrow agreement. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to approve the substitution of securities by NebraskaLand National Bank as pledged to the Lincoln County Treasurer. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 21, 2012. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
There were no motor vehicle tax exemption applications.
Motion by Hewgley, seconded by Deterding to approve the waiver for Calvary Baptist Church to allow the County Assessor to make a recommendation on the requested tax exemption application. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
County Assessor, Julie Stenger, reported that the state is encouraging counties to look more closely at the exemption applications and there have been a few changes for this year.

County Assessor, Julie Stenger was excused and Deputy County Assessor, Pat Collins was present.
The Lincoln County Board of Equalization adjourned at 10:10 A.M. and the Lincoln County Board of Commissioners reconvened.
Highway Supt., Jerry Hitchcock, told board members that Perrett Construction has approached the county as he would like to build a road in the future with access off of Highway 83 located in the SW ¼ of Section 2; Township 14 North, Range 30 West. He did contact the Nebraska Dept. of Roads concerning this access and was told it would be easier to have a government entity apply. There will be no cost to Lincoln County for the road or driveway access. The road would have to be built to standards and the county would have to consider at that time if they would to accept the road or not.
Commissioner Deterding asked who would decide where the driveway would be located.
Hitchcock responded that is would be up to the state.
Mrs. Ziegler spoke in opposition to the request as there is no advantage to the county as it is a private individual and the time being spend on the process will be at the taxpayers’ expense.
Hitchcock replied that the time would be minimal.
Commissioner Hewgley commented that Perrett Construction had a number of trucks and /or other equipment and there might be some advantage as it would not interrupt the current traffic and would not be tearing up other roads.
Ziegler told board members that if this road is accepted in the future it will be a burden to taxpayers and again stated that he should be responsible for his own road and driveway.
Nancy Petes stated as well that the county should not be involved. If a private individual wants a road he can do it himself. You can get the application off the internet and this project is not on the One & Six Year Road Plan that was just adopted.
Hitchcock stated that was correct as it not a project that exists right now.
Bruce Richman commented that he owns the property that the road would go across. He objected originally, but now that it is re-zoned it might be advantageous to him and the county to have a road.
County Board requested that the Highway Supt. obtain additional information on the application process before a decision is made.
Motion by Hewgley, seconded by Deterding to continue the matter concerning driveway access onto Highway 83 by Perrett Construction for one week. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
Deb McCarthy, Clerk of District Court, reported that LB 669 is asking for the County Court and District Court to help each other if needed. She feels that LB would be more advantageous for the smaller counties. Both offices here are sufficiently staffed and they would like to opt out of the agreement.
Motion by Hewgley, seconded by Deterding to authorize the board chairman to draft and sign a letter to the proper individual stating there is already a good spirit of cooperation and Lincoln County will have things continue as they are and not enter into the agreement. Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.
