Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe
Hewgley, Duane Deterding, Willis Roethemeyer, and Deputy County Clerk, Terry
Heessel. Commissioner Deterding offered prayer.   Chairman Roethemeyer called
the meeting to order at 9:00 A.M.

 

 

Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public
review and the county board will comply with the open meeting requirements.

 

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln
County Board of Commissioners meeting held on July 23, 2012.  Upon roll call vote Hewgley,
Deterding and Roethemeyer voted “aye”.  Nays, none.

 

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s
receipts.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.
Nays, none.

 

 

Motion by Hewgley, seconded by Deterding to approve the DED Annual Audit Notification
and authorize Chairman to sign.  Upon roll call vote Hewgley, Deterding and Roethemeyer
voted “aye”.  Nays, none.

 

 

Motion by Deterding, seconded by Hewgley to approve the fee report submitted by the
County Sheriff.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.
Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the right of way application
submitted by Great Plains Communication and authorize the Chairman to
sign.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.
Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve the right of way application
submitted by Walz Farms LLC and authorize the Chairman to sign.  Upon roll call
vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the right of way application
submitted by Gordon Sanders and authorize the chairman to sign.  Upon roll call
vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County
Board of Equalization convened.

County Assessor, Julie Stenger, appeared.

 

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln
County Board of Equalization meeting held on July 23, 2012.  Upon roll call vote Hewgley,
Deterding and Roethemeyer voted “aye”.  Nays, none.

 

 

Motion by Hewgley, seconded by Deterding to approve the certificates of correction and
refund submitted by the County Assessor and authorize the Chairman to sign.  Upon roll
call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

Motion by Hewgley, seconded by Deterding to approve the notice of valuation change
numbered 2012-39 as submitted by the County Assessor.  Upon roll call vote Hewgley, Deterding and
Roethemeyer voted “aye”. Nays, none.

 

 

Mr. Ronald Fleecs appeared to explain his reasoning for protesting the valuation
change notice # 2012-009 dated June 11, 2012.  He believes that the wetland
on his property should not be valued as recreational land.  It is his choice to
have the land remain a wetland and not use it as recreational.

 

 

County Assessor, Julie Stenger, stated that WRP land cannot be valued as ag land and
is to be valued as recreational.  There have only recently been any sales of land that
is comparable to what he protesting.  Since these sales were in 2012, this will be
reviewed in 2013 to see if WRP land should be valued any differently.

 

Commissioner Hewgley stated that in the last month, in reviewing property valuation protests
filed that some adjustment was made.

 

 

Motion by Hewgley, seconded by Deterding to revalue parcel #83595.00 owned by L. Ronald
Fleecs located in E ½ SE ¼ of 3-13-33.  The land is to be revalued to $64,460.

 

Upon roll call vote Hewgley and Deterding voted “aye”.  Roethemeyer voted “nay”.

 

 

Motion by Hewgley, seconded by Deterding to go into closed session at 10:10 A.M. to
discuss strategy regarding litigation to protect attorney client privilege,
which is clearly necessary to protect the public interest.  Upon roll call vote Hewgley, Deterding and
Roethemeyer voted “aye”.  Nays, none.

 

 

Motion by Hewgley, seconded by Deterding to return to open session at 10:19 A.M. with
no action taken.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.
Nays, none.

 

 

The Lincoln County Board of Equalization recessed at 10:20 A.M. and the Lincoln
County Board of Commissioners reconvened.

 

 

Register of Deeds, Lois Block, requested that the County Board sign an agreement with
Manatron Inc. – A Thomson Reuters Business for software and services.  This is the
software and service that the office has been using since 2000.

 

 

Motion by Hewgley, seconded by Deterding to approve the agreement for licensed
software and services, and authorize the Chairman to sign.  Upon roll call vote Hewgley, Deterding and
Roethemeyer voted “aye”.  Nays, none.

 

 

County Assessor, Julie Stenger, gave an overview of the Three-Year Plan of Assessment
Update for Lincoln County 2012 as submitted by the State of Nebraska.

 

 

County Sheriff, Jerome Kramer, requested the County to sign an application to the NE
Office of Highway Safety for a mini-grant contract application for the National
You Drink & Drive.  You Lose.  Crackdown for wages and mileage in the amount
of $8,000.00

 

Motion by Deterding, seconded by Hewgley to authorize the Chairman to sign the

Mini-Grant contract application with the Nebraska Office of Highway Safety.  Upon
roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

 

County Noxious Weed Superintendent, Rod Yost, requested approval to purchase tracks
for a mule that is used by the department.  The department has two mules that have
been an asset to the department.  Last year it was within the budget to buy one set
of tracks for one mule but now the second mule is in need of replacement.

 

 

Motion by Hewgley, seconded by Deterding to give approval for the Noxious Weed
Department to purchase a set of tracks for a mule.  Upon roll call vote Hewgley, Deterding and
Roethemeyer voted “aye”.  Nays, none.

 

Approved the claims as presented for payment.

 

 

Commissioner Hewgley was excused from the meeting at 10:37 A.M.

 

 

The meeting was adjourned at 10:50 A.M.

 

 

Advance notice and the agenda for the July 30, 2012 board meetings were sent to members
of the County Board, County Attorney and all others requesting the same.  Notice was posted
at the Lincoln County Courthouse, City Hall and on the county website.

 

 

The agenda for the meetings to be held on Monday, August 6, 2012 will be kept
continually current and open for inspection at the office of the Lincoln County
Clerk.  The regular meeting of the
Lincoln County Board of Commissioners will be at the Lincoln County Courthouse
in the Commissioners Room at 9:00 A.M.
The regular meeting of the Lincoln County Board of Equalization will be
at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
