Meeting of the Lincoln County Board of Commissioners. Present were Commissioners  Joe Hewgley, Duane Deterding, Willis Roethemeyer, and County Clerk, Rebecca Rossell.  Roethemeyer offered prayer.  Chairman Roethemeyer called the meeting to order at 9:00 A.M.

 

Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 29, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:16 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger and Deputy County Treasurer, Deb McNeel appeared.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 29, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Hewgley, seconded by Deterding to approve the motor vehicle tax exemption applications as approved by the County Treasurer on Bethel Evangelical Church, First Church of the Nazarene and North Platte Baptist Church.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve the motor vehicle tax exemption applications as approved by the County Treasurer on Salvation Army and West Central District Health Department.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2012-32 instructing the Lincoln County Attorney’s Office to continue to seek Judgment for reimbursement of Guardian Ad Litem fees paid by the County from the parties involved in the Domestic Relations Actions and to use whatever legal means necessary to collect on the Judgment.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

County Clerk Rossell left at 9:30 A.M. and Deputy County Clerk, Terry Heessel, was present.

 

Dan Guenthner, EM Director, introduced his new Emergency Management Assistant, Tammy Dugger.

 

Highway Supt., Jerry Hitchcock, gave his report concerning vacation of a portion of Foothill Road, said portion is located in Section 33, Township 15N, Range 31W, Lincoln County, Nebraska requested by Jerry Steffes.

 

He reported the trail is no longer a mail route and hasn’t been used in years.  He recommended that a 2,963 foot stretch of Foothill Road 11 miles northwest of North Platte be vacated.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2012-33 be set for public hearing on November 26, 2012 at 10:00 A.M. to receive comments on the vacation of the part of Foothill Road located in Section 33; Township 15N; Range 31W, Lincoln County, Nebraska.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The following bids were received for motor grader blades for the Lincoln County Dept. of Roads:

Motion by Hewgley, seconded by Deterding to accept the low bid of NMC for a total of $17,288.40 for motor grader blades.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

An informational presentation was held to introduce the companies that will be working on Project RRZ-TMT-DPU-1390(3), Control No. 61416 (Birdwood/Front Road Grade Separation).  Mainelli Wagner and Associates, LLC from Lincoln, NE will be the county’s representative for the project and Sema Construction of Centennial, Colorado is the general contractor.  Scott Gerrard, vice president of Sema’s railroad division gave a brief rundown of the construction process.

 

Kent Miller, Twin Platte NRD general manager, and Dan Smith, general manager of Middle Republican NRD appeared to discuss the recent purchase of Lincoln Farms, LLC.  They explained that the land was purchased to help Nebraska stay in compliance with state regulations concerning the use of irrigated water.  Miller reported that the other option would have been to impose water restrictions on irrigators to meet the requirements.

 

Leonard Hiatt questioned pipeline across private land,

 

Miller said the districts have the authority to envoke eminent domain.

 

Dan Estermann questioned the economic ramifications of removing corn production from this land.

 

The cost of the $83 million farm will be paid for through occupation tax of $4 to $6 an acre imposed on local irrigators.

 

County Board requested that the NRD’s make a regulation that the sale won’t result in a loss of tax dollars to the county and that the taxes on the farm would stay at the current rate.

 

The NRD will be holding public forums at future meetings.
