Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 14, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to approve and adopt Resolution No. 2013-03 to approve the county depositories for 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to receive and order filed the Condition of the Treasury of Lincoln County, NE from July 1, 2012 – December 31, 2012. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to appoint Dan Manookin to the Lincoln County Safety Committee to finish the unexpired term of Jack Gier. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January14, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to approve and authorize the chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Roethemeyer, seconded by Deterding to set February 11, 2013 at 10:00 A.M. for public hearing regarding the One & Six Year Road Plan for Lincoln County, Nebraska. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Item 6 on the agenda came up for discussion and consideration.

 

Judy Clark, Lincoln County Planning Director and Rod Christmann, Chairman of the Lincoln County Planning Commission briefed the County Board concerning the questions addressed at the last county board meeting concerning the Comprehensive Development Plan Update 2011-2030.

 

Christmann stated that the Planning Commission had not changed their recommendation concerning the Comprehensive Plan Land Use map but if the County Board decided to make a change the Planning Commission would be o.k. with the change.

 

Commissioner Hewgley stated there were two options concerning this matter. To accept the Planning Commission’s recommendation and leave the area in question on the Comprehensive Plan Land Use Map as Light Industrial or to change it to transitional agriculture. He commented that he would like to see both maps (Comprehensive Plan Land Use Map and Zoning Map) be consistent.

 

Commissioner Roethemeyer commented that he would also like to see the plans coincide and reminded those in attendance that the Comprehensive Plan can always be changed down the road.

 

Commissioner Deterding thanked the Planning Commission for their work and for the public that came in to express their concerns.

 

Commissioner Deterding stated that this Resolution adopts the recommendation by the Lincoln County Planning Commission to adopt the LINCOLN COUNTY, NEBRASKA COMPREHENSIVE DEVELOPMENT PLAN UPDATE 2011 TO 2030 with modifications stated therein.

 

Further, the modifications are with regards to changes on page 167 of the LINCOLN COUNTY, NEBRASKA COMPREHENSIVE DEVELOPMENT PLAN UPDATE 2011 TO 2030 concerning future land use, showing a change of some land from an Industrial District to a Transitional Agricultural District.

 

Motion by Deterding, seconded by Roethemeyer to approve and adopt Resolution No. 13-04, which adopts the recommendation of the Lincoln County Planning Commission, with modifications, concerning the LINCOLN COUNTY, NEBRASKA COMPREHENSIVE DEVELOPMENT PLAN UPDATE 2011 TO 2030. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Chairman Hewgley declared the motion passed and that Resolution No. 13-04 is duly adopted, passed, and approved.

 

Item 7 on the agenda came up for discussion and consideration.

 

Commissioners stated that Resolution 13-05 includes the recommendation from the Planning Commission and the grammar and typo corrections and the minor changes (concerning animals) as presented by Keith Marvin regarding animals during the public hearing and correction of the resolution number located on Page 54.

 

Motion by Deterding, seconded by Roethemeyer to approve and adopt Resolution No. 13-05, and give authority to the Chairman to sign the Resolution (Resolution No. 13-05) for the Board of Commissioners of The county of Lincoln, Nebraska; direct that the Resolution be spread in the minutes; direct that the Resolution be printed in booklet or pamphlet form by Pro Printing & Graphics; and that the Resolution shall be known, cited, and referred to as the “Zoning Regulations of The county of Lincoln, Nebraska.” Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Chairman Hewgley declared the motion passed and that Resolution No. 13-05 is duly adopted, passed, and approved.

 

Inserted below (spread in the minutes) is a true and correct copy of the following: Resolution No. 13-05 in its entirety including the land use table and the Official Zoning Map of “The county of Lincoln, Nebraska”.

 

Item 8 on the agenda came up for discussion and consideration.

 

There were no changes to the recommended Subdivision Regulations.

Motion by Roethemeyer, seconded by Deterding to approve and adopt Resolution No. 13-06, which adopts the new Subdivision Regulations that shall be known, cited, and referred to as “The Subdivision Regulations of The county of Lincoln, Nebraska,” and direct that the Resolution and The Subdivision Regulations of The county of Lincoln, Nebraska, incorporated therein, be printed in booklet or pamphlet form by Pro Printing & Graphics. Upon roll call vote Roethemeyer, Deterding and Hewgley voted “aye”. Nays, none.

Chairman Hewgley declared the motion passed and that Resolution No. 13-06 is duly adopted, passed, and approved.

Advance notice and the agenda for the January 22, 2013 board meetings were sent to members of the County Board, County Attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, January 28, 2013 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
