Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 25, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve and authorize the chairman to sign a right of way permit submitted by Don Colvin. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to accept and authorize the chairman to sign a quote with ACS for AS400 system hardware maintenance. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

A General & Medical Assistance appeal was filed by Dr. Melvin Canell for denial of a county burial. It was approved as a burial and then was done as a cremation without notifying the department of the change.

 

HHS & Dr. Canell both submitted requests in writing asking for a continuance of the appeal.

 

Motion by Deterding, seconded by Roethemeyer to continue the appeal filed by Dr. Melvin Canell to Monday, March 11, 2013 at 9:30 A.M. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger appeared as well as Becky McDaniel representing the County Treasurer.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 25, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to approve and authorize the chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve the motor vehicle tax exemption application submitted by North Platte Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:19 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Lois Block, Register of Deeds, told board members that she already has electronic recording in her office. There is no charge to the county. She is requesting that Corporation Service Co. be added.

 

Motion by Deterding, seconded by Roethemeyer to enter into an agreement with Corporation Service Co. for electronic recording with the Register of Deeds office. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye’. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to approve the appointment of Dr. Wendy Gosnell as Physician for the West Central District Health Department Board of Health. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to set March 25, 2013 at 10:00 A.M. to receive bids on one new or used semi truck for the Lincoln County Department of Roads. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to set March 25, 2013 at 10:15 A.M. to receive bids on one new or used ¾ ton pickup for the Lincoln County Department of Roads. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to go into closed session at 10:15 A.M. concerning strategy regarding litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Chairman Hewgley restated the reason for the closed session.

 

Motion by Roethemeyer, seconded by Deterding to go into open session at 11:28 A.M. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

No action was taken following the closed session.

Advance notice and the agenda for the March 4, 2013 board meetings were sent to members of the County Board, County Attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, March 11, 2013 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
