Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer and County Clerk, Rebecca Rossell. Commissioner Hewgley was absent. Roethemeyer offered prayer. Vice Chairman Deterding called the meeting to order at 9:00 A.M.

 

Vice Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on April 1, 2013. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Roethemeyer, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Roethemeyer, seconded by Deterding to approve and authorize the vice chairman to sign the right of way application submitted by Frey Pivot Services, Inc. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Deterding, seconded by Roethemeyer to approve and authorize the vice chairman to sign the right of way application submitted by Dawson Public Power District. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Roethemeyer, seconded by Deterding to approve the substitution of securities by NebraskaLand National Bank as pledged to the County Treasurer. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Roethemeyer, seconded by Deterding to receive and order filed the fee reports submitted by the County Court and County Clerk. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

No certificates of correction or refund submitted by the County Assessor.

 

County Assessor, Julie Stenger, explained that the Assessor’s Office and protestors had both agreed to the new value on the properties (listed below) that had been sent to TERC and had been changed for various reasons.

 

Motion by Roethemeyer, seconded by Deterding offering a confession of judgment regarding the case of West Park Townhomes, LLC, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 12C-126, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses the value of the real estate in said herein motion to be $2,080,500 (Land – $216,495 and Improvements $1,864,005) for tax year 2012. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

Motion by Roethemeyer, seconded by Deterding offering a confession of judgment regarding the case of Phillip Perry, Appellant, v. Lincoln County Board of Equalization, Appellee, Case 12C-011, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses the value of the real estate in said herein motion to be $2,257,100 (Land – $58,180 and Improvements $2,198,920) for tax year 2012.   Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

Motion by Roethemeyer, seconded by Deterding offering a confession of judgment regarding the case of Phyllis J. Heiss, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 12R-035, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses the value of the real estate in said herein motion to be $64,060 (Land – $8,155 and Improvements $55,905) for tax year 2012. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

Motion by Roethemeyer, seconded by Deterding offering a confession of judgment regarding the case of Jerry L. Miller, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 12R-010, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses the value of the real estate in said herein motion to be $124,780 (Land – $16,310 and Improvements $108, 470) for tax year 2012. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

The Lincoln County Board of Equalization adjourned at 9:28 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Roethemeyer, seconded by Deterding to approve and authorize the Vice Chairman to sign the 2013 Victim Witness Grant Application. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

Deputy County Attorney, Joe Wright, commented that the upcoming comparability study for the Lincoln County Sheriff’s Office is under $5,000 and does not require a bidding process.

 

Motion by Roethemeyer, seconded by Deterding to approve the Scope of Services and associated costs (total cost under $5,000) with Capital City Concepts, LLC to do a comparability study for the Lincoln County Sheriff’s Office. Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

 

Motion by Roethemeyer, seconded by Deterding to approve and adopt Resolution No. 2013-08 adding three additional road projects to the 2013 One Year Road Plan. (Armor coat a segment of Antelope Road, Armor Coat a segment of Hershey/Dickens Road and Asphalt overlay a segment of Medicine Road.) Upon roll call vote Deterding and Roethemeyer voted “aye”. Nays, none. Hewgley absent.

Advance notice and the agenda for the April 8, 2013 board meetings were sent to members of the County Board, County Attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, April 15, 2013 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
