Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley, County Board Assistant Tammy White and Deputy County Clerk, Terry Heessel. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on September 3, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve the fee report as submitted by the Clerk of District Court. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to approve the right of way application submitted by McCook Public Power District. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger, and Appraisers, Charity Farley, Henry Vogt and Angie Bargmann appeared.

 

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on September 3, 2013. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Deterding to authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Mike Humphrey of Double Dog Ranch LLC was present to discuss four special valuation protests submitted. The ranch is now a cow/calf operation. There has been fencing and livestock added and dead trees removed. This land is north of the interstate in Sections 6 & 7, Township 13, Range 34. The ranch also has hay, wheat and dry land corn.

 

County Assessors, Charity Farley and Henry Vogt visited the property in July of 2013 and there was evidence that cattle was being run on the property. Also the wheat was visible.

 

There was considerable discussion on how many cattle were on the property, how many acres were hay, wheat and corn. Also how the crops were harvested was questioned.

 

Roethemeyer stated that his concern is for the established farmers in Lincoln County. It is because of the new buyers paying such a large amount for land, it is driving up the valuation.

 

Commissioner Hewgley stated that even though the steps have been made to make this property agricultural ground, the evidence does not show this land is to provide a livelihood.

 

Motion by Deterding, seconded by Roethemeyer to affirm the decision of the Lincoln County Assessor and deny Double Dog Ranch LLC application and appeal on Protest # 2013-4SV on parcel # 0094035.00. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to affirm the decision of the Lincoln County Assessor and deny Double Dog Ranch LLC application and appeal on Protest # 2013-3SV on parcel #0093985.00. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to affirm the decision of the Lincoln County Assessor and deny Double Dog Ranch LLC application and appeal on Protest # 2013-1SV on parcel #0093990.00. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Roethemeyer to affirm the decision of the Lincoln County Assessor and deny Double Dog Ranch LLC application and appeal on Protest # 2013-2SV on parcel #0093970.00. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 10:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Judy Clark, Planning Director, was present to discuss Huebner Administrative Subdivision application. This subdivision will split the agricultural dwelling site of 5.69 acres from the remaining agricultural property. The County Planning Staff has no objections as the subdivision meets all current Lincoln County Zoning and Subdivision Regulations and is in conformance with the Lincoln County Comprehensive Plan.

 

Motion by Deterding, seconded by Roethemeyer to approve the application by Miriam Huebner for the Huebner Administrative Subdivision. The property is located at 648 South Hershey-Dickens Road described as a tract of land in the SE ¼ of the NE ¼ of Section 5, Township 13 North, Range 32 West of the 6th P.M. Lincoln County, Nebraska in a TA-1 Transitional Ag District. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

 

A budget work session was conducted.

 

Approved the following claims as presented for payment:

 

The meeting scheduled at 12:00 P.M. with elected officials was cancelled.

 

The meeting was adjourned at 11:54 A.M.

 

Advance notice and the agenda for the September 9, 2013 board meetings were sent to members of the County Board, County Attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, September 16, 2013 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
