Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.
Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on May 5, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to receive and order filed the fee reports submitted by the Register of Deeds and Clerk of District Court. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve entering Lincoln County, Nebraska, into a Settlement Agreement and Release with Roche Constructors, Inc., in regards to an action before the United States District Court for the District of Nebraska, styled Roche Constructors, Inc. v. Lincoln County, Nebraska (Case No. 7:12CV5011), and authorize the Lincoln County Board Chairman to sign the Settlement Agreement and Release for Lincoln County, Nebraska. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on May 5, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Carol Bender appeared concerning a protest of rejection of homestead exemption for tax year 2013. She is having issues and would appreciate any assistance the county could give her.
County Assessor, Julie Stenger, reported that Bender did not file a homestead exemption application in 2013. She has filed an application for 2014 which should be approved. There is nothing to be done by state statute.
Commissioners agreed that by law there is nothing they can do for the 2013 tax year.
Motion by Hewgley, seconded by Roethemeyer to deny the request for homestead exemption for tax year 2013 submitted by Carol Bender as the board has no jurisdiction on this matter. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to go into closed session at 9:27 A.M. concerning strategy regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Chairman restated the motion for the closed session.
Motion by Roethemeyer, seconded by Hewgley to go into open session at 9:34 A.M. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
No action was taken following the closed session.
The Lincoln County Board of Equalization adjourned at 9:35 A.M. and the Lincoln County Board of Commissioners reconvened.
The special designated liquor permit submitted by Bull’s Bar & Grill was postponed to the next board meeting as the applicant could not appear.
Motion by Hewgley, seconded by Roethemeyer to approve entering The county of Lincoln, Nebraska, into a contract with Western Engineering Company, Inc., in regards to the Asphalt Concrete Project for the Lincoln County Department of Roads, Project Number LCDOR 2014-1, and authorize the Lincoln County Board Chairman to sign the written contract for The county of Lincoln, Nebraska in the amount of $1,081,290. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Sheriff Kramer appeared and stated that the RENOVO hardware and software being requested are just an addition to the current system. They are unique items and no other vendors could add to the current system, so it was not put out for bid.
Motion by Hewgley, seconded by Roethemeyer to approve entering The county of Lincoln, Nebraska into an amendment to the VisPay Agreement with RENOVO Software, Inc. in regards to additional hardware and software which would allow professional and public visitors to visit over the web with the inmates housed at the Lincoln County Detention Center, and authorize the Lincoln County Board Chairman to sign the written amendment for The county of Lincoln, Nebraska. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to go into closed session at 10:21 A.M. concerning strategy regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the May 12, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.
The agenda for the meetings to be held on Monday, May 19, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
