Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on September 29, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to place on file the fee reports submitted by the County Clerk and County Court. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the withdrawal of securities by NebraskaLand National Bank as pledged to the Lincoln County Clerk. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign the Certification of Cost Allocation Plan for Fiscal Year 2013 A-87 Cost Allocation Plan for child support services with Maximus. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger and County Treasurer, Sue Fleck appeared.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on September 29, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve the motor vehicle tax exemption application by North Platte Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution No. 2014-18 setting the 2014 tax levies for all political subdivisions. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to offer a confession of judgment regarding the case of The Village of North Platte, LP, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 13C 104, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses in said herein motion that the value of the real estate, in the aforementioned case (Case No. 13C 104). Should be $1,450,000.00 (Land – $113,255.00 and Improvement – $1,336,745.00) for tax year 2013. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of Commissioners reconvened.

 

County Highway Supt., Jerry Hitchcock, reported the Supplemental agreement with NDOR is for a Central Nebraska Public Power District Bridge and is commonly referred to as the Sioux Lookout Bridge.

 

Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution 2014-

19 authorizing the Chairman to sign Supplemental #2 LPA Program Agreement for

Project No. BR-1480 Control No. 51414 (Maxwell Southwest). Upon roll call vote

Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve the purchase of materials and/or services from the following for the remodel of the new location of the North Platte/Lincoln County Visitors Bureau: Crewdy’s Masonry and Dowhower Construction. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve consenting & waiving any conflict Baird Holm LLP with D. A. Davidson & Co. concerning advising Lincoln County, Nebraska regarding potential self-reporting under the SEC’s Municipal Continuing Disclosure Cooperation (“MCDC”) initiative with respect to the bond issues concerning the Lincoln County Sheriff’s Office & Detention Center Project and also sign an Engagement Letter for legal services concerning the aforementioned and give the Chairman authorization to sign all necessary documents. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

 

The following bids was received for relocating the World War I monument and flag poles:   Irving P. Haitt – $38,800

 

Commissioner Hewgley asked when he planned to begin the project.

 

Hiatt responded just as soon as we can get a contract signed.

 

Commissioner Deterding inquired about his plans for the project.

 

Hiatt replied with a step by step process for getting the project completed.

 

Motion by Hewgley, seconded by Roethemeyer to approve and accept the bid of Irving P. Hiatt in the amount of $38,800 as submitted. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the October 6, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, October 13, 2014 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
