Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Willis Roethemeyer, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.
Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 15, 2014. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve increasing the mileage rate to 57.5 cents per mile effective January 1, 2015 as per the IRS guidelines. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve and authorize the Chairman to sign the right of way applications submitted by McCook Public Power District. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign the right of way application submitted by Consolidated Companies Inc. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution 2014-34 authorizing the Lincoln County Attorney to foreclose “A” tax sale certificate(s) issued by the Lincoln County Treasurer. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve the Special Designated Liquor License submitted by Sculley LLC for an event on January 24, 2015 at the Lincoln County Fairgrounds. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.
Jayna Schaff, Community Connections Executive Director, presented the two grant applications for approval. It is basically the same applications as previous years except the state advised them not to include CASA and Bridge of Hope in this year’s applications and to concentrate on those programs who helped assist with 3B cases.
Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign two grant applications submitted by Community Connections: 2015 Community-Based Juvenile Services Aid Grant and 2015 Community-Based Juvenile Services Aid Enhancement Grant. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve the purchase of materials and/or services from the following for the remodel of the new location of the North Platte/Lincoln County Visitors Bureau: Condon Signs – $19,487.14 with no additional cost for freight or sales tax (the change in terms concerning sales tax and freight was initialed by both parties) and authorize the Chairman to sign. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Dan Manookin, Building & Grounds Director, reported that the county offices had been contacted concerning the available chairs in storage that were available and there was no response.
Motion by Hewgley, seconded by Roethemeyer to approve declaring office chairs, as described below, located at the Lincoln County’s Storage unit to be surplus personal property and which is obsolete or not useable by the county, to wit:
a) 9 modern manager chairs, brown leather
b) 21 antique arm chairs, black leather and oak; and
c) 15 antique manager chairs, black leather and oak.
Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve setting the value of $40.00 each for the 9 modern manager chairs in brown leather and $20.00 each for the antique chairs which are personal property (office chairs) determined to be surplus property and which is obsolete or not useable by Lincoln County. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve Dan Manookin to sell the office chairs declared to be surplus personal property and which is obsolete or not useable by the county as listed above, subject to these conditions and/or restrictions given by the county board: 1) advertise in the two local papers for 2 weeks; 2) sale will be set for January 10, 2015 from 10:00 A.M. to 12:00 P.M.; 3) sale will be conducted at 2415 East 4th Street – Unit #5; 4) cash sales only. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve to accept comments from the Lincoln County Planning Commission, by and through a letter from Judy Clark (Lincoln County Planning Administrator), regarding the conformity of the proposed acquisition to comprehensive planning for the area submitted by The Nebraska Land Trust Incorporated that is acquiring a conservation easement on real property owned by Todd McWha and Laura McWha, husband and wife, located in the South 500 feet of the West 750 feet of Section 7 and the West Half of the North Half of the North Half (W ½ N ½ N ½) of Section 18, all in Township 16 North, Range 33 West of the 6thP.M., Lincoln County, Nebraska, and all of Section 12, Township 16 North, Range 34 West of the 6th P.M., Lincoln County, Nebraska. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve the proposed acquisition submitted by The Nebraska Land Trust Incorporated that is acquiring a conservation easement on real property owned by Todd McWha and Laura McWha, husband and wife, located in the South 500 feet of the West 750 feet of Section 7 and the West Half of the North Half of the North Half (W ½ N ½ N ½) of Section 18, all in Township 16 North, Range 33 West of the 6th P.M., Lincoln County, Nebraska, and all of Section 12, Township 16 North, Range 34 West of the 6th P.M., Lincoln County, Nebraska. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve to accept comments from the Lincoln County Planning Commission, by and through a letter from Judy Clark (Lincoln County Planning Administrator), (with one correction to change from Range 3 to Range 33 on the letter) regarding the conformity of the proposed acquisition to comprehensive planning for the area submitted by The Nebraska Land Trust Incorporated that is acquiring a conservation easement on real property owned by Terrance O. Waite and Karen Waite, husband and wife, located in all of Section 7,except the South 500 feet of the West 750 feet of Section 7, and the East Half of the North Half of the North Half (E ½ N ½ N ½) of Section 18, all in Township 16 North, Range 33 West of the 6thP.M., Lincoln County, Nebraska. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Roethemeyer to approve the proposed acquisition submitted by The Nebraska Land Trust Incorporated that is acquiring a conservation easement on real property owned by Terrance O. Waite and Karen Waite, husband and wife, located in all of Section 7,except the South 500 feet of the West 750 feet of Section 7, and the East Half of the North Half of the North Half (E ½ N ½ N ½) of Section 18, all in Township 16 North, Range 33 West of the 6thP.M., Lincoln County, Nebraska. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Alan Hirschfeld, Dan Mauk and Rob Stefka spoke concerning the proposed relocation of the Post Office to Industrial Avenue.
Motion by Hewgley, seconded by Roethemeyer to approve and adopt Resolution No. 2014-35 (read in its entirety) relating to the relocation of the United States Post Office from 300 E 3rdStreet in North Platte, Nebraska to the facility located at 1302 Industrial Avenue in North Platte, Nebraska. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Motion by Roethemeyer, seconded by Hewgley to approve going into closed session at 10:55 A.M. regarding a strategy session concerning collective bargaining and imminent litigation, and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.
Chairman restated the motion for the closed session.
Motion by Roethemeyer, seconded by Hewgley to approve going into open session at 11:40 A.M. Upon roll call vote Roethemeyer, Hewgley and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the December 22, 2014 were sent to the county board and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.
The December 29, 2014 board meetings have been cancelled.
The agenda for the meetings to be held on Monday, January 5, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
