Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:08 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 16, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve Jerry Pigsley’s continuing representation of the County and request all files and documents of the County possessed by Harding & Shultz, PC, LLO, be transferred to Woods & Aitken LLP and to authorize the Chairman to sign the engagement letter when received. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve hiring Capital City Concepts, LLC, to do a comparability study concerning the Lincoln County Sheriff’s Office in the amount of $4,950.00. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 16, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on real property. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the motor vehicle tax exemption application by North Platte Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:19 A.M. and the Lincoln County Board of Commissioners reconvened.

Sheriff Kramer reported he had no objection to the special designated liquor permit submitted by Unreel Events.

Motion by Deterding, seconded by Henry to approve the special designated liquor permits submitted by Unreel Events LLC for the Lincoln County Raceway on April 11 & May 9, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Lincoln County Emergency Management Director, Brandon Myers, made a presentation of certificates for the Severe Weather Awareness Poster Contest through Emergency Management to the top three posters from Hall School and also a certificate from the Nebraska Emergency Management Agency for Honorable Mention for the first place recipient.

Motion by Deterding, seconded by Henry to approve accepting the resignation of Justin Dailey, who is currently the interim Lincoln County Weed Control Superintendent, and the elimination of the interim position. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve the appointment/hiring of Todd Herndon to be the “Lincoln County Weed Control Superintendent” effective immediately.   Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The following bids were received for micro-surfacing for Lincoln County Department of Roads:

Sta-Bilt Construction Co.                $788,400.00

Monarch                                            $768,150.00

Motion by Henry, seconded by Deterding to approve the acceptance of the bid of Monarch in the amount of $42,675 per mile or a total of $768,150.00. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to set April 13, 2015 at 10:00 A.M. to accept bids for asphalt overlay for Lincoln County Department of Roads. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to go into closed session at 10:23 A.M. regarding a strategy session concerning collective bargaining and pending litigation, and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session

Motion by Henry, seconded by Deterding to go into open session at 11:20 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve appointing Joe Hewgley as the representative from the Lincoln County Board of Commissioners in negotiating the Labor Agreement with the Fraternal Order of Police Lodge #26, Lincoln County Sheriff’s Employees’ Association, Inc. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Advance notice and the agenda for the March 23, 2015 were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 20, 2015; and was also emailed to the media on March 20, 2015.

The agenda for the meetings to be held on Monday, March 30, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
