Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M. 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 17, 2015.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.    

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none. 

Motion by Deterding, seconded by Henry to approve the Interlocal agreement with the City of North Platte for dispatch services effective October 1, 2015 in the amount of $9,656.84 per month.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the Interlocal agreements between Lincoln County and the City of North Platte for road maintenance from October 1, 2015 to September 30, 2016 in the amount of $1733.00 per month.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve the Special designated liquor permit submitted by Sculley LLC for a reception to be held at Harbor Lights on September 1, 2015.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

The Lincoln County Board of Commissioners recessed at 9:18 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 17, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

Highway Supt., Jerry Hitchcock, stated that Supplement No. 4 will allow Mainelli Wagner & Associates, LLC enough hours to do what is needed to close out the project.

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2015-13

authorizing the Chairman to sign Supplement No. 4 to the Construction Engineering

Services Agreement for Birdwood Grade Separation, RRZ-1390(3), Control No. 61416.

 Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Mark Mainelli representing Mainelli Wagner & Associates, Inc. appeared to discuss the

services offered by his company when working on disaster projects such as the South

River Road Erosion Project.  They work with FEMA and NEMA, take care of permits

and all the necessary paperwork for the disaster.

Commissioner Hewgley asked about cost to the county for these services.

Mainelli replied that is would be part of the project cost and would be reimbursed by

consideration for the final project.

County Board requested that the firm supply a Scope of Services and fee structure

to the County Board for consideration.

Discussion was held concerning the tort claim submitted by CenturyLink for damages.

Wyatt Arensdorf, County Road Department Employee reported that a crew was working

in the ditch and parallel to where they were digging at the edge of the pavement.  He

hit a line located at the edge of the pavement.  The locate company came after the

line had already been hit and marked an additional line along the edge of the asphalt.

Motion by Deterding, seconded by Henry to approve going into closed session at 9:53

attorney client privilege, which is clearly necessary to protect the public interest. Upon

roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Deterding, seconded by Henry to approve going into open session at 10:00

Motion by Deterding, seconded by Henry to approve to receive the tort claim and take

no action on the claim submitted by CenturyLink.  Upon roll call vote Deterding, Henry

and Hewgley voted “aye”.  Nays, none.

Motion by Henry, seconded by Deterding to approve the special designated liquor

permit submitted by the Golden Spike Tower for a sampling/tasting event to be held on

September 19, 2015 at the Golden Spike Tower.  Upon roll call vote Deterding, Henry

and Hewgley voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2015-14

by the Lincoln County Board of Commissioners determining final allocation of levy for

political subdivisions under the county levy.  Upon roll call vote Deterding, Henry and

Hewgley voted “aye”.  Nays, none. 

Motion by Deterding, seconded by Henry to approve that The county of Lincoln, in the

State of Nebraska, enter into an agreement, entitled Lake Maloney Trail Agreement,

 with the Lake Maloney Property Owners Association, and authorize this  Board’s

Chairman to sign said Agreement on behalf of the Board and the County.  Upon roll call

vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve that The county of Lincoln, in the

State of Nebraska, the recipient, enter into an Escrow Agreement with Mid-Nebraska

Community Foundation, the contributor, andTitle Services of the Plains, LLC, the

escrow agent, and authorize this Board’s Chairman to sign said Escrow Agreement on

behalf of the Board and the County.  Upon roll call vote Deterding, Henry and Hewgley

voted “aye”.  Nays, none.

Deputy County Attorney, Joe Wright, gave a brief update regarding the County’s application for a grant from the Nebraska Game and Parks Commission regarding the Project known as “Lake Maloney Hiking and Biking Trail, Phase 2.”  There were some

very minor changes to the document.

The County Board of Commissioners held a 2015/2016 Lincoln County Budget Work

Approved the following claims as presented for payment:

Advance notice and the agenda for the August 24, 2015 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 21, 2015; and was also emailed to the media on August 21, 2015.

The agenda for the meetings to be held on August 31, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
