Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on September 8, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve setting the annual salary of Carla O’Dell as Lincoln County Highway Superintendent at $51,600 as of September 19, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of way application submitted by CenturyLink. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to receive and order filed the fee report submitted by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:17 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on September 8, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The County Assessor appeared to present information and documentation concerning the denial of the Homestead Exemption application for Martin Sellers. The appeal had been denied by the Lincoln County Board of Equalization on August 31st but due to an office error Mr. Sellers did not receive the notice of hearing on August 31st. He was mailed a second notice so he could have a chance to appear before the Lincoln County Board of Equalization today.

Mr. Sellers stated he is remodeling the residence on file at the County Assessor’s Office and has been living there off and on since the remodeling started.

County Assessor, Julie Stenger, reported that it is too late to file for a transfer to another address but he needs to make sure the Assessor’s Office has the correct address so they know what house would qualify for the exemption next year when he reapplies.

No additional action was taken on the homestead exemption application submitted by Martin Sellers. The application had been denied by the County Board of Equalization on August 31, 2015.

Motion by Henry, seconded by Deterding to approve to accept the recommendation of the Lincoln County Assessor to deny the request on the property valuation protest on Parcel # 78812.20 (Part of Lot 2, Niedan-Olson Subdivision) valued as residential in the amount of $6340. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:44 A.M. and the Lincoln County Board of Commissioners reconvened.        

Motion by Deterding, seconded by Henry to approve sending out a Request for Proposal (RFP) for work on the South River Road Erosion Project for the FEMA process. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the request for increasing the office space in the Evans Building for District 11 Probation based on the proposal and change that will need to be made in the contract. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Commissioner Hewgley was excused at 9:54 A.M.

A public hearing was opened at 10:00 A.M. to receive comments on the proposed 2015/2016 fiscal year Lincoln County, Nebraska budget.

Susan Maline, CPA, gave a brief overview of the proposed budget document.

Bernadine Zeigler asked about the use of the inheritance tax, the jail bond fund and the Building Fund. She encouraged taxpayers to look closely at the annual tax statements to see the amount of taxes collected by the other subdivisions in each tax district.

Eric Seacrest congratulated the board on the long term project plan for renovating the courthouse. He encouraged them to replace old pickups and maintainers for the County Road Department as there was a cut from the amount requested by the County Road Department for this budget year.

No other comments were received.

The public hearing was closed at 10:20 A.M.

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2015-17 adopting the 2015/2016 fiscal year Lincoln County, Nebraska budget. Upon roll call vote Deterding and Henry voted “aye”. Nays, none. Hewgley absent.

A public hearing was opened at 10:30 A.M. to receive comments relating to setting the final tax levy request at a different amount than the prior year tax request.

No comments were received.

The public hearing was closed at 10:45 A.M.

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2015-18 setting the final tax levy request at a different amount than the prior year tax year in the amount listed of $12,300,388 with a tax levy of .277045. Upon roll call vote Deterding and Henry voted “aye”. Nays, none. Hewgley absent.

Advance notice and the agenda for the September 14, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on September 11, 2015; and was also emailed to the media on September 11, 2015.

The agenda for the meetings to be held on September 21, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
