Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 12, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to place on file the fee reports submitted by County Sheriff. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the Right of Way applications submitted by Dawson Public Power District and Sandhills Service LLC. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the Special Designated Liquor License submitted by Sculley LLC for an event on November 6, 2015 for a reception at Harbor Lights. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign Management Representation Letter addressed to Don Wilson, CPA. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 12, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

No certificates of correction or refund submitted by the County Assessor.

Motion by Deterding, seconded by Henry to approve going into closed session at 9:16 A.M. regarding a strategy session concerning pending litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Henry, seconded by Deterding to approve going into open session at 9:28 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:29 A.M. and the Lincoln County Board of Commissioners reconvened.        

Motion by Henry, seconded by Deterding to approve an application by L & D Campbell, LLC for Campbell Estates Third Subdivision. The property is located on Fairway Dr. on the south side of South Maloney Dr.at Lake Maloney and is described as part of the SE ¼ of Section 7, Township 12 North, Range 30 West of the 6th P.M. Lincoln County, Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

County Planning Administrator, Judy Clark, read the comments from the Lincoln County Planning Commission concerning the conservation easement submitted by Todd and Laura McWha.

Motion by Henry, seconded by Deterding to approve the Conservation Easement on proposed acquisition by Nebraska Land Trust regarding conservation easement on property owned by Todd and Laura McWha. The property is located on approximately 303.5 acres described as a tract of land in Section Eleven (11), Township Eleven (11) North, Range Twenty-Seven (27) West of the 6th P.M. Lincoln County Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

                                                           

Representatives of Nebraska Public Power District gave a Transmission Line Project Update.

Carla O’Dell, County Road Superintendent, gave a report on distances and speed limits on Walker Road as requested by the Board of Commissioners. The area was monitored at different times on different days for speed, use of the rumble bars and jake braking.

Emergency Management Director, Brandon Myers, gave a quarterly report for the period July 1, 2015 to September 30, 2015.

Motion by Henry, seconded by Deterding to approve to set November 9, 2015 at 10:00 A.M. to receive bids on a pole barn to be located at the Lincoln County Department of Roads. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve to set November 9, 2015 at 10:15 A.M. to receive bids on a sound system for the Lincoln County District Court of Lincoln County Courthouse. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve going into closed session at 10:35 A.M. regarding a strategy session concerning pending litigations and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the motion for the closed session.

Motion by Henry, seconded by Deterding to approve going into open session at 10:40 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Advance notice and the agenda for the October 19, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 16, 2015; and was also emailed to the media on October 16, 2015.

The agenda for the meetings to be held on October 26, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
