Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and Deputy County Clerk, Terry Heessel. Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 9, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Henry to approve the cancellation of the December 28, 2015 Board of Commissioners & Board of Equalization meetings. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Henry, seconded by Deterding to approve authorizing the Chairman to sign the response letter concerning Fiscal Year Ending June 30, 2015 audit findings. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Henry to receive and order filed the fee report submitted by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Henry to approve the special designated liquor permit submitted by Sculleys LLC for a reception to be held at Harbor Lights on December 11, 2015 . Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Deterding, seconded by Henry to approve Resolution 2015-24 substitution of securities by Hershey State Bank as pledged to the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Motion by Henry, seconded by Deterding to approve authorizing the Chairman to sign an agreement with Martin Troshynski to be the conflict attorney in matters where he would represent individuals who are indigent and entitled to representation, in which he is Court appointed to represent such individuals in criminal matters, juvenile matters under subsections (1), (2), 3(a), and 3(b) of Neb. Rev. Stat. §43-247, mental health proceedings, child support contempt, and paternity cases. This agreement is for 1 Year starting July 1, 2015 through June 30, 2016. Upon roll call vote Deterding, Henry and Hewgley vote “aye”. Nays, none.
William Troshynski appeared before the board to request a shortened term in the agreement for his services in guardianship and conservatorship matters. Sometimes the cases snowball and require more time. He does not feel there will be any drastic changes.
Motion by Deterding, second by Henry to approve authorizing the Chairman to sign an agreement with William Troshynski to provide legal services in guardianship and conservatorship matters to those individuals who have been found to be indigent and entitled to representation, in which he is court appointed to do such representation. The agreement shall be for six months commencing July 1, 2015 through December 31, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

No certificates of correction or refund submitted by the County Assessor.
The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of Commissioners reconvened.
Emergency Management Director, Brandon Myers, present to explain the benefits to the county to sign a resolution to enter into a interlocal agreement with other Nebraska Public Agencies participating in the Nebraska Regional Interoperability Network. This agreement establish NRIN and a NRIN Governing Board to govern, manage and coordinate to support public safety communications in Nebraska.
Motion by Deterding, seconded by Henry to approve Resolution 2015-25 and authorize the Chairman to sign the resolution to enter into the agreement for the formation and participation in the Nebraska Regional Interoperability Network. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Gary Person, CEO/President North Platte Area Chamber & Development and Megan McGown, Vice-President introduced themselves to the County Board of Commissioners. They are introducing themselves to key officials within the community and looking forward to working with the County in developing growth within the county.
Lois Block, County Register of Deeds, and Les Greene, IT Director, presented informal bids on purchasing a big format printer for the office. The current printer is very old and soon will be out dated to use with the current computer programs. This printer is used by other County Offices such as the Department of Roads and County Assessor. The funds to pay for this equipment will come out of the P & M Fund, not the county budget.
Motion by Henry, seconded by Deterding to approve the purchase of a Cannon 785 from Salina Blueprint for the amount of $7,095.00. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Carla O’Dell, County Roads Superintendent, was present for the opening of the following motor grader blade bids:
Murphy Tractor & Equipment Co. Total Bid $24,331.02
Titan Machinery Total Bid $32,044.60
NMC Inc. Total Bid $23,558.50
Commissioner Hewgley asked the County Roads Superintendent to look over the low bid. As per Carla O’Dell the bid meets the specifications of the County.
Motion by Henry, seconded by Deterding to accept the bid of NMC Inc. for motor grader blades in the amount of $23,558.50. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Judy Clark, Lincoln County Planning and Dana Daniels of Miller and Associates representing N-CORP was present for discussion on an application by Albert and Arta Sonneman for T.P.N.R.D. Administrative Subdivision. The subdivision will divide a .11 acre lot from a tract of land located approximately 7 miles south and 6 miles west of North Platte on Miller School Road. This property is located in an A-1 Agricultural District. The applicants are requesting this lot for the purposed installation/construction of a vault.
Judy Clark considered Section 3.33 of the Lincoln County Zoning Regulations which allows a public utility to divide a parcel of ground smaller than the required lot size if the property is going to be used to construct pols, wires, cables, conduit, vaults, laterals, pipes, mains, valves or similar equipment for transmission of electricity, gas or water.
Dana Daniels explained that this vault is going to be used for the transmission of water.
Commissioner Hewgley questioned that Twin Platte is a Natural Resources District not a public utility, and would like an opinion from the County Attorney’s office.
Mr. Daniels felt that Twin Platte would be considered a private business. After further discussion this matter was tabled until an opinion could be obtained from the County Attorney’s office.
Motion by Henry, seconded by Deterding to appoint the Chairman, Joe Hewgley, to continue negotiations with the F.O.P. Lodge #26, regarding meeting the requirements of Neb. Rev. Statute 48-1230. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.
Joe Hewgley left the meeting at 10:31 A.M.
Motion by Deterding, seconded by Henry to have Jerry Pigsley continue his representation of the County, (includes the Sheriff & the Board of Commissioners) regarding matters with F.O.P. Lodge #26, which includes giving him authority to appeal decisions where the County is a party involving F.O.P. Lodge #26. Upon roll call vote Deterding and Henry voted “aye”. Nays, none. Hewgley absent.

Advance notice and the agenda for the November 16, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 13, 2015; and was also emailed to the media on November 13, 2015.
The agenda for the meetings to be held on November 23, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
