Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and Deputy County Clerk, Terry Heessel.  Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 29, 2016.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to authorize Chairman to sign Commercial Credit Application for PC Mall for the I.T. Department.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to receive and order filed the fee report submitted by the County Clerk, County Court and Clerk of District Court.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of way application submitted by Dennis Brown.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, second by Henry to authorize the Chairman to sign the County/City Lottery Operator License Renewals to be submitted to the Nebraska Department of Revenue.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:17 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 29, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Becky McDaniel of the County Treasurer’s office appeared.

 

Motion by Deterding, seconded by Henry to approve the motor vehicle exemption application submitted by the Riverside Baptist Church on a 2003 Lincoln Town Car as recommended by the County Treasurer.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve the motor vehicle exemption application submitted by the Berean Fundamental Church on a 2009 Ford Econoline Van as recommended by the County Treasurer.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the motor vehicle exemption application submitted by the North Platte Baptist Church on a 1990 Chevrolet Bus as recommended by the County Treasurer.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve the motor vehicle exemption application submitted by the New Life Assembly on a 2012 Chrysler Town & Country Van as recommended by the County Treasurer.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to go into closed session at 9:25 A.M. regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the reason for the closed session.

 

Motion by Deterding, seconded by Henry to into open session at 9:42 A.M.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:42 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Paul Grieger and Andy Forney of D.A. Davidson & Co. in Omaha, Nebraska were present to discuss jail bonds.

 

Motion by Deterding, second by Henry to adopt Resolution 2016-7 calling the County’s Outstanding General Obligation Refunding Bonds, Series 2011, for redemption prior to maturity.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, second by Henry to adopt Resolution 2016-8 authorizing the issuance of General Obligation Refunding Bonds, Series 2016, in an amount not to exceed Five Million Three Hundred Thousand Dollars ($5,300,000) for the purpose of paying and redeeming the County’s outstanding General Obligation Refunding Bonds, Series 2011 and related matters.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Veterans Service Officer, Paul Cooper was present to request appointments to the Veterans Service Committee.

 

Motion by Deterding, seconded by Henry  to accept the resignation of Ken George and appoint Jerry Jurgens to serve the remainder of the term which ends June 30, 2016.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The appointment of Jerry Jurgens to a 5year term will be done in June of 2016.

 

Motion by Henry, seconded by Deterding to appoint Stephen Anton to continue on the Lincoln County Veterans Service Committee for a 5 year term, from July 1, 2015 to June 30, 2020.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry for The county of Lincoln, Nebraska to enter into an agreement with Bill Troshynski to provide legal services in guardianship and conservatorship matter to those individuals who have found to be indigent and entitled to representation, in which he is Court appointed to do such representation and authorize the Chairman to sign.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Advance notice and the agenda for the March 7, 2016 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 4, 2016; and was also emailed to the media on March 4, 2016.

 

The agenda for the meetings to be held on March 14, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
