Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 7, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to place on file the fee reports submitted by the Register of Deeds and County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve the withdrawal of securities by NebraskaLand National Bank as pledged to the County Clerk. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of way permit submitted by Don Colvin. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the right of way permit submitted by Central Nebraska Public Power District. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 7, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Deterding, seconded by Henry to approve to set the date of April 4, 2016 at 10:00 A.M. for public hearing concerning South River Road. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve to set the date of April 11, 2016 at 10:00 A.M. to receive bids for asphalt overlay for the Lincoln County Department of Roads. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve to set the date of April 11, 2016 at 10:15 A.M. to receive bids for micro-surfacing for the Lincoln County Department of Roads. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve to refer the tort claim filed by Theresa Swanson for damage to her vehicle to the County insurance carrier. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

John Steel – Blue Lodge of Masons appeared to discuss a monument by Ft McPherson dedicated in 1931. The monument is leaning and is unstable.  He would like to see something done with it similar to what the Boy Scouts did with the soldier monument in that same area.

 

Commissioner Hewgley asked if the monument was originally placed by the Masons.

 

They responded that was correct.

 

Mr. Steel stated they would need dirt, gravel, white rock, a culvert, wrought iron fencing and a park bench to make it comparable to the Boy Scout project. The monument would need to be moved and put in place then it could be cleaned up and restored.

 

Commissioner Hewgley requested that he come back with a formal plan including cost, number of hours of labor and ingress and egress distances.

 

Discussed a petition received from Donald Goddard concerning replacing/installing culverts in the creek area of South Old Military Road in Maxwell, NE. He stated that he was told a culvert would be installed by the former Highway Supt.  He then commented that nobody lives within 2 ½ miles downstream.

 

Commissioner Hewgley suggested having Carla O’Dell, the current Highway Supt. do a study of the area and make a recommendation to the County Board.

 

Commissioner Henry commented that it is low ground and we don’t want the road to restrict the water either.

 

Commissioner Deterding said when you live by a river you are going to have water and we need to be concerned with everyone in that neighborhood.

 

Commissioner Hewgley stated that we are talking about a large area being flooded and we need to study it and see what can be done. Whatever we do it needs to try to be done right.

 

Deputy County Attorney, Joe Wright, updated the County Board on the Lake Maloney Hiking and Biking Trail, Phase 2 and went over the Recreation Use Agreement with NPPD. He is also working on an amendment to the agreement with Lake Maloney Property Owners Association so it will match the other agreements.

 

Motion by Deterding, seconded by Henry to approve going into closed session at 10:48

A.M. concerning strategy session, regarding real estate purchase of property for Lincoln

County, Nebraska, and to protect attorney client privilege, which is clearly necessary to

protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted

“aye”. Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Deterding, seconded by Henry to approve going into open session at 11:05

A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Advance notice and the agenda for the March 14, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 11, 2016; and was also emailed to the media on March 11, 2016.

 

The agenda for the meetings to be held on March 21, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
