Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on May 9, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-13 for substitution of securities by Gothenburg State Bank as pledged to the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-14 for substitution of securities by NebraskaLand National Bank as pledged to the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to place on file the fee report submitted by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on May 9, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization recessed at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

A Public hearing was opened at 9:31 A.M. for discussion regarding Lincoln County Board of Commissioners, based on the Board’s power to purchase real estate for The

county of Lincoln, in the State of Nebraska, attempting to purchase a parking lot

located at 115-115 ½ West 2nd Street, North Platte, Nebraska from LeRoy W.

Wood, for an amount of $72,500, which has a legal description of “The West 54’ of Lot

6, Block 161, Original Town to the City of North Platte, Lincoln County, Nebraska.”

 

Commissioner Hewgley commented that this real estate would be purchased to regain some of the parking that was lost when the new Sheriff’s Office and Detention Center was constructed.

 

Alan Hirschfeld, Michael Phillips, Bernice Zeigler and Eric Seacrest spoke in favor of the county purchasing the lot to increase available parking for county employees and to ease the difficulty in finding a parking spot around or near the courthouse.

 

Donna Cross, who will be opening a restaurant in the near future, next to the parking lot asked if her customers would be allowed to park there.

 

Chairman Hewgley responded that it is the County Boards intention for it to be private parking for county employees.

 

James Johnson asked if he could buy the lot and lease spots to the county instead.

 

Chairman Hewgley replied that this has been done through an open process with a realtor.

 

The public hearing was closed at 9:45 A.M.

 

Motion by Deterding, seconded by Henry to approve and give authority to the Lincoln County Board Chairman to enter into an agreement for the Board to purchase a parking lot located at 115-115 ½ West 2nd Street, North Platte, Nebraska,  from LeRoy W. Wood, for an amount of $72,500.00, which has a legal description of “The West 54’ of Lot 6, Block 161, Original Town to the City of North Platte, Lincoln County, Nebraska,” subject to being finalized through the consummation of the transaction acquiring the property (real estate) by the Lincoln County Board of Commissioners and LeRoy W. Wood at least thirty days after the Public Hearing held on May 16, 2016, per Neb. Rev. Stat. § 25-2505.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve the special designated liquor permit submitted by the Golden Spike Tower for a reception to be held on June 5, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve entering The county of Lincoln,

Nebraska, into a contract with Western Engineering Company, Inc., in regards to an

Asphalt Concrete Paving Project on West Island Road and Banner Road for the Lincoln

County Roads Department, Project Number LCDOR 2016-2, and authorize the Lincoln

County Board Chairman to sign the written contract for The county of Lincoln,

Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve entering The county of Lincoln,

Nebraska, into a contract with Sta-Bilt Construction Company in regards to a Micro-

Surfacing Project on Hershey-Dickens Road and North Hershey Road for the Lincoln

County Roads Department, Project Number LCDOR 2016-1, and authorize the Lincoln

County Board Chairman to sign the written contract for The county of Lincoln,

Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley issued a Proclamation to recognize National Police Week 2016 from

May 15, 2016 through May 21, 2016.

The Lincoln County Board of Commissioners recessed at 10:30 A.M. and the Lincoln County Board of Equalization reconvened.

 

County Assessor, Julie Stenger, appeared with two appraisers from her office.

 

Motion by Henry, seconded by Deterding to go into closed session at 10:31 A.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Deterding, seconded by Henry to go into open session at 10:47 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 10:48 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The County Board met with other elected officials at noon.

Advance notice and the agenda for the May 16, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on May 13, 2016; and was also emailed to the media on May 13, 2016.

 

The agenda for the meetings to be held on May 23, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
