Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Henry offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 27, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve authorizing the Chairman to sign Region II Human Services Interlocal Participation Agreement for Fiscal Year 2016-2017. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-31 for addition of securities by NebraskaLand National Bank as pledged to the County Clerk. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the right of Way application submitted by Charles W. Boden. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 27, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Henry, seconded by Deterding to approve the motor vehicle tax exemption application submitted by North Platte Catholic Schools. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve the motor vehicle tax exemption application submitted by Great Plains Health. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

County Assessor, Julie Stenger, appeared concerning special valuation protests that had been filed and were heard at the last County Commissioner’s meeting. She stated her office’s position was to still deny the special valuation protests heard last week.  She commented that several had also filed regular protests.  Several of these parcels will be considered for rural residential pricing except for the accretions.

 

Jerome Vieyra reported that the property surrounding his property are not desirable properties and have a much lower value.

 

Commissioners Henry and Deterding stated that the County did not set the market values. The properties are selling at these prices on the open market.

 

Motion by Deterding, seconded by Henry to deny the special valuation protest filed by Jerome Vieyra numbered 2016-1SV agreeing with the County Assessor and making no change. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to deny the special valuation protest filed by Jerome Vieyra numbered 2016-2SV. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Mr. Peck stated he did not understand why he has to pay more taxes than the parcels surrounding his property. He also cannot sell the property due to stipulations placed on it.

 

Commissioner Hewgley replied that he understood that he cannot sell the property.

 

Commissioner Henry commented for the record that his son just bought the property next to Mr. Peck so there might be a possible conflict of interest.

 

Motion by Henry, seconded by Deterding to deny the special valuation protest filed by Francis C. Peck, Sr. numbered 2016-3SV. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Smiths commented they had no additional information.

 

Motion by Henry, seconded by Deterding to deny the special valuation protest filed by Bonnie J. Smith numbered 2016-4SV. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Donald Goddard stated that in 2010 it was valued as Ag and questioned what changed it.

 

Motion by Henry, seconded by Deterding to deny the special valuation protest filed by Donald Goddard numbered 2016-5SV. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve notice of valuation changes numbered 2016-083 & 2016-084 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 10:11 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Judy Clark, Planning Director, reported that Planning Staff had no objections to either one of the applications before the County Board.

 

Motion by Deterding, seconded by Henry to approve application SU16-002 by Charles

and Jaquelyn Morgan for Morgan Administrative Subdivision located in an R-2 Urban

Density Residential Agricultural District located on Highway 97. Legal description is part

of the NW ¼ of Section 10, Township 14 North, Range 30 West of the 6th P.M. Lincoln

County, Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.

Motion by Deterding, seconded by Henry to approve application SU16-001 by Mortensen Farm & Ranch Co. for Mortensen Administrative Subdivision located in an A-1 Agricultural District on Fox Creek Road. Legal description is part of the NW ¼ of Section 22, Township 9 North, Range 28 West of the 6th P.M. Lincoln County, Nebraska.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the County Attorney Sub Award

between Nebraska Health & Human Services & Lincoln County for Child Support

Enforcement. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays,

none.

 

Motion by Henry, seconded by Deterding to approve the special designated liquor

permit submitted by Jane & Eldon Chestnutt (Jim’s Bar in Arnold) for a reception to be

held on July 30, 2016 at Harbor Lights. Upon roll call vote Deterding, Henry and

Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve the special designated liquor

permit submitted by North Platte Jaycees for a charitable event to be held on August 4,

2016 at Harbor Lights. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.

Nays, none.

 

Recess at 11:18 A.M. as the Lincoln County Board of Commissioners and reconvene as

the Lincoln County Board of Equalization.

 

Discuss and consider Property Valuation Protests (Form 422).

 

Recess at 1:04 P.M. as the Lincoln County Board of Equalization and reconvene as the

Lincoln County Board of Commissioners.

Advance notice and the agenda for the July 5, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 1, 2016; and was also emailed to the media on July 1, 2016.

 

The agenda for the meetings to be held on July 11, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
