Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Henry offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 8, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016- 41 for withdrawal of securities pledged to the County Clerk by NebraskaLand Bank. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the fee report submitted by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 8, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Bill Summers appeared to discuss the special valuation protest he had filed on two properties. He commented that both previous owners of the property had been classified as agricultural.  He did put a fence around the property.  He has never leased it for cattle or hunting.  In the future he will allow cattle on it and he does get hay from a portion of the property.

 

 

 

County Assessor, Julie Stenger, reported that notices had been sent in 2010 & 2016 explaining the special valuation methodology to all property owners that were affected. If there is a lease they could classify it as agricultural.

 

Motion by Henry, seconded by Deterding to make no change and accept the County

Assessor’s recommendation on Protest 2016-12SV as submitted by William F. Summers. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to make now change and accept the County Assessor’s recommendation on Protest 2016-13SV as submitted by William F. Summers. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the motor vehicle tax exemption application for Mission Life Inc. as recommended for approval by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:56 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Judy Clark, Planning Director, read the review comments and stated that planning staff had no objections to the application for Stalker Administrative Subdivision as submitted.

 

Motion by Deterding, seconded by Hewgley to approve File No. SU16-003 an application by Aaron Stalker for Stalker Administrative Subdivision located at 14489 East State Farm Road on property described as Part of the S ½ SW ¼ of Section 36; Township 13N; Range 29W. Upon roll call vote Deterding and Hewgley voted “aye”.  Nays, none.  Henry abstained.

 

Motion by Deterding, seconded by Henry to approve the reappointments of existing Lincoln County Planning Commissioner members for three year terms: Rodney Rayburn, Betty Sones, Linda Hansen & Roger Merritt.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the manager application for Suzanne Carr for Oregon Trail Golf Course located at 31200 West Tower Road in Sutherland, NE. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Discussed the diagnostic railroad crossing review at McCullogh Road as received from the State of Nebraska in which they requesting the county to contribute 5% of the cost to install active warning devices at this crossing location.

 

Motion by Henry, seconded by Deterding declining to participate in the funding for the McCullogh Road crossing project. The County Board has no problem with the project if the state and rail road pursue it further.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve the special designated liquor permit submitted by the Golden Spike Tower for a reception to be held on September 16, 2016 at the Golden Spike Tower. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

County Board held a budget work session

 

County Board met with other elected officials and department heads at noon.

Advance notice and the agenda for the August 15, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 12, 2016; and was also emailed to the media on August 12, 2016.

 

The agenda for the meetings to be held on August 22, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
