Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Hewgley offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 3, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to place on file the fee reports submitted by the County Clerk, Register of Deeds and Clerk of District Court. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize Carla O’Dell, Lincoln County Highway Supt., to make purchases up to $4999 without County Board approval. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

County Board did request that the Highway Supt. inform the County Board Chairman of such purchases as needed.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-63 for withdrawal of securities by NebraskaLand National Bank as pledged to the Lincoln County Clerk. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 3, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-64 setting the 2016 tax levies for all political subdivisions. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Gerald Hudson presented comparable properties in the area of his property, discussed flooding issues and reported that he had contacted several realtors for information.

 

County Assessor, Julie Stenger, explained how Lincoln County came up with the cost per acre on these parcels and discussed the comparables he presented.

 

Motion by Henry, seconded by Deterding to deny valuation change protest 2016-VCP-2 submitted by Gerald & Joyce Hudson making no change and leaving the value at the County Assessor’s recommendation. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:45 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-65 approving a four year agreement with the Village of Brady for law enforcement services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-66 approving a four year agreement with the Village of Hershey for law enforcement services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-67 approving a four year agreement with the Village of Sutherland for law enforcement services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-68 approving a four year agreement with the Village of Wallace for law enforcement services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-69 approving a four year agreement with the Village of Wellfleet for law enforcement services. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The following bids were received for two motor graders for the Lincoln County Department of Roads:

Motion by Deterding, seconded by Henry to approve and accept the following bids on motor graders for the Lincoln County Department of Roads: Bid 1 from NMC with the $10,500 trade in allowance in the amount of $118,500 and Option 4 from Murphy Tractor with the trade in allowance of $17,000 in the amount of $137,500.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The following bids were received for three new pickup trucks for the Lincoln County Department of Roads:

 

Janssen Chrysler                $29,959 each

Plum Creek Motors              $30,544.30 each

Jerry Remus                         $31,100 each

Bill Summers                                    $30,552 each

 

Motion by Deterding, seconded by Henry to approve and accept the bid of Janssen Chrysler for three Dodge Ram pickup trucks for the Lincoln County Department of Roads in the amount of $29,959 each or a total of $89,877.00. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve going into closed session at 10:38 A.M. concerning a strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Henry, seconded by Deterding to approve going into open session at 10:50 A.M. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Advance notice and the agenda for the October 10, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 7, 2016; and was also emailed to the media on October 7, 2016.

 

The agenda for the meetings to be held on Monday, October 17, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
