Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 7, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the renewal software agreement with CIC Inc. for the Register of Deeds. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to place on file the fee reports submitted by the Register of Deeds, Clerk of District Court and County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-72 for a substitution of securities by First National Bank as pledged to the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-73 for a substitution of securities by Gothenburg State Bank as pledged to the County Treasurer. Upon roll call vote Deterding,  Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve to hire Tim Brouillette as co-counsel in Lisa A. Seachord Chapter 7 Bankruptcy. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Deputy County Assessor, Pat Collins appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 7, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Planning Director, Judy Clark reviewed the application submitted by Larry and Donna Campbell. Larry was there to answer any questions for the County Board.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-74 regarding File No. SU16-005 an application by Lawrence and Donna Campbell to vacate Lots 1-11 Campbell Estates 3rd Subdivision and all easements indicated on the subdivision plat located on property described as Part of the SE ¼ of Section 7, Township 12 North, Range 30 West of the 6th P.M., Lincoln County, Nebraska.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign the final 2016 VOCA grant for submission to the Nebraska Crime Commission. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Trent Engleman was not present to discuss the tort claim he had filed.

 

Sheriff Kramer reported that the car had been impounded due to a court order. He had a police report concerning the incident.

 

Motion by Henry, seconded by Deterding to receive the tort claim filed by Trent Engleman and refer it to the county’s insurance carrier. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Law Enforcement had no objections to the special designated liquor permit being applied for by Rustic Tavern or Mullen, NE.

 

Motion by Deterding, seconded by Henry to approve the special designated liquor permit submitted by the Rustic Tavern of Mullen, NE for a reception to be held at Harbor Lights on December 31, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

Advance notice and the agenda for the November 14, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 10, 2016; and was also emailed to the media on November 10, 2016.

 

The agenda for the meetings to be held on Monday, November 21, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
