Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry and County Clerk, Rebecca Rossell.  Commissioner Hewgley was absent. Henry offered prayer. Vice Chairman Henry called the meeting to order at 9:04 A.M.

 

Vice Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 28, 2016. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.   Hewgley absent.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding and Henry  voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-76 to amend occupation tax and special designated permit fees for liquor licenses to add a Class L liquor license. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to place on file the fee report submitted by the County Sheriff. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and authorize the Vice Chairman to sign the rental contract with Microfilm Imaging Systems for the Photostat Department. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and authorize the Vice Chairman to sign the letter giving 30 day notice to Commercial Investment Services for the storage unit. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-77 approving the substitution of securities by Adams Bank & Trust as pledged to the County Treasurer. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-78 authorizing the Lincoln County Attorney to foreclose “C” tax sale certificates issued by the Lincoln County Treasurer. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-79 authorizing the Lincoln County Attorney to foreclose the lien of all special assessments delinquent with the City of North Platte, on all real estate where delinquent special assessments of land that has been offered for sale for special assessments two (2) consecutive years and not sold for want of bidder, and which have had issued against them a Tax Sale Certificate. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well County Treasurer, Sue Fleck.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 28, 2016. Upon roll call vote Deterding and Henry voted “aye”. Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and authorize the Vice Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve the motor vehicle tax exemption applications submitted by Harvest Christian Fellowship Church and Region II Human Services as recommended for approval by the County Treasurer. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Henry, seconded by Deterding to approve the motor vehicle tax exemption applications submitted by Region II Services and Riverside Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

The Lincoln County Board of Equalization adjourned at 9:30 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The Public Hearing on the application submitted by Pals Brewing Company LLC DBA

Pals Brewing Company for a Class L Craft Brewery (Brew Pub) License located at 4520

S Buffalo Bill Avenue, North Platte, NE, was opened at 9:32 A.M.

 

Paul and Amy Oettinger the applicants were sworn and proceeded to give a brief

description of the proposed plan for the Craft Brewery. It is a 10 barrel brewery.  They

will have a small tap room and snacks available.

 

Sheriff Kramer stated he had been involved in a traffic study concerning the proposed

brewery and reported there was no evidence to support a negative effect on traffic. He

had no issue with the application.

 

The public hearing was closed at 9:43 A.M.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-80 recommending approval of the application submitted by Pals Brewing Company LLC DBA Pals Brewing Company for a Class L Craft Brewery (Brew Pub) license. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

It was discovered at a later time that the Notice of Public Hearing was not published in the newspaper on the specified date. The County Clerk’s office contacted the Nebraska Liquor Control Commission on how to proceed. The county was instructed to publish the Notice of Public Hearing and hold another public hearing at a future date.  The applicants and news media were contacted about the change.

 

Motion by Deterding, seconded by Henry to rescind Resolution No. 2016-80 as the Notice of Public Hearing was not published by the North Platte Telegraph as required by law. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

The following bids were received for the construction of the Lake Maloney Hike and Bike Trail Phase II (and the extra .10 mile):

After review of the bids by the grant project manager and engineering consultant it was reported that the bids were over the $280,429 construction grant award by a total of $7611.50. Schedule 1 is over by $4845.00 and Schedule 2 is over by $2766.50.

 

The County Board will contact the Lake Maloney Property Owner’s Association to determine if they are willing to cover the additional cost.

 

Motion by Deterding, seconded by Henry to continue until the December 12, 2016 Commissioner’s meeting at 10:00 A.M. to consider the bids on the Lake Maloney Hike and Bike Trail Phase II (and the extra .10 mile). Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to approve and authorize the Vice Chairman to sign entering The county of Lincoln, in the State of Nebraska, into agreements with GIS Workshop, LLC (“GISW”) concerning Web-based services for the benefit of the Lincoln County Roads Department, which includes the following: Master Services Agreement, Exhibit A “Statement of Work,” and Exhibit B “Terms of Service.” Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

Advance notice and the agenda for the December 5, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 2, 2016; and was also emailed to the media on December 2, 2016.

 

The agenda for the meetings to be held on Monday, December 12, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
