Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Hewgley offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 17, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to place on file the fee report submitted by the County Sheriff. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to give authority to Chairman Henry to sign for the County a proof of claim in the Cody Fletcher Chapter 13 Bankruptcy, Case No. 14-40969 regarding Guardian Ad Litem fees owed to Lincoln County. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to place on file a sale of surplus report for the fiscal year ending June 30, 2016 for the Lincoln County Department of Roads. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to place on file the Condition of the Treasury of Lincoln County, Nebraska from July 1, 2016 to December 31, 2016. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 17, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve the exemption application on real and personal property submitted by Berean Fundamental Church of North Platte as recommended for approval by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the exemption application on real and personal property submitted by St. Patrick’s Catholic Church of North Platte as recommended for approval by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The public hearing was opened at 9:32 A.M. on the application submitted by Pals Brewing Company LLC dba Pals Brewing Company for a Class I (Beer, Wine, Distilled Spirits – On Sale Only) located at 4520 S Buffalo Bill Avenue, North Platte, NE.

 

Paul Oettinger, co-owner of Pals Brewing Company stated that they felt the Class I license would be a good addition to the Class J Brewery license. It would allow those that do not like beer to also be able to purchase a beverage.

 

No other comments were received.

 

The public hearing was closed at 9:36 A.M.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2017-04 recommending approval of the Class I liquor license for Pals Brewing Company LLC dba Pals Brewing Company located at 4520 S Buffalo Bill Avenue, North Platte, NE. Deterding and Henry voted “aye”.  Nays, none.  Hewgley abstained as he was involved with the design of the building.  Motion carried.

 

Motion by Hewgley, seconded by Deterding to set February 13, 2017 at 10:00 A.M. for the One & Six Year Road Plan hearing for the Lincoln County Department of Roads. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to acknowledge receipt of Resolution No. AM16-001 from the Lincoln County Planning Commission, concerning proposal to Repeal Section 4.15 of the “Zoning Regulations of The county of Lincoln, Nebraska,” titled “Proposed Repeal of Section 4.15 AH – Airport Hazard/Approach Overlay District. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to acknowledge receipt of Resolution No. AM16-002 from the Airport Zoning Commission for The county of Lincoln, Nebraska, concerning proposal on the “Proposed Initial Zoning of Airport Hazard Area under the Airport Zoning Act” and the Airport Hazard Area Map. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Timothy Aden, owner of the Longhorn Bar in Sutherland, NE appeared to discuss the two special designated liquor permit applications he submitted for upcoming receptions.

 

Sheriff Kramer stated he had no objections to the permits.

 

Motion by Deterding, seconded by Hewgley to approve the special designated liquor permit submitted by Aden Enterprises LLC (Longhorn Bar- Sutherland, NE) for receptions to be held on June 9 & June 10, 2017 at Paulman Farms, 28042 W Power Road, Sutherland, NE. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the special designated liquor permit submitted by Aden Enterprises LLC (Longhorn Bar – Sutherland, NE) for a reception to be held on September 23, 2017 at Harbor Lights, 711 North Lake Road, North Platte, NE. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Brandon Myers, Region 51 Emergency Management Director, gave his quarterly report from October 1, 2016 to December 31, 2016.

 

Noxious Weed Superintendent, Todd Herndon, gave the annual report for his department.

 

The 10:45 A.M. report by the North Platte/Lincoln County Visitors Bureau was postponed.

Advance notice and the agenda for the January 23, 2017 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 20, 2017; and was also emailed to the media on January 13, 2017.

 

The agenda for the meetings to be held on Monday, January 20, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
