Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Hewgley offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.
Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on April 3, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to receive and order filed the fee reports submitted by Clerk of District Court, Register of Deeds and County Clerk. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to authorize the Chairman to sign the contract with Nebraska Fire and Safety concerning security matters. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on April 3, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to offer a confession of judgment regarding the case of Daniel M. Wesslund, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 16R 0201, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses in said herein motion that the value of the real estate, in the aforementioned case (Case No. 16R 0201), should be $213,000.00 (Leasehold Value – $160,000 and Improvements – $53,000) for tax year 2016. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
Motion by Deterding, seconded by Hewgley to offer a confession of judgment regarding the case Thomas M. Phifer, Appellant, v. Lincoln County Board of Equalization, Appellee, Case No. 16R 0056, which is before the Nebraska Tax Equalization and Review Commission, in which the Lincoln County Board of Equalization confesses in said herein motion that the value of the real estate, in the aforementioned case (Case No. 16R 0056), should be $235,270.00 (Land – $15,570 and Improvements – $219,700) for tax year 2016. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:26 A.M. and the Lincoln County Board of Commissioners reconvened.
Discussion was held concerning an Interlocal agreement that had been received from McPherson County for the joint purchase of supplies and materials & equipment sharing.
Lincoln County Highway Supt, Carla O’Dell, addressed the possible costs to Lincoln County if Lincoln County entered into the agreement. She also did not see a mutual benefit to Lincoln County the way the agreement was written.
Commissioners also stated they did not see a benefit to the taxpayers of Lincoln County and that we have and will continue to help neighboring counties in emergency situations.
No action was taken on the Interlocal agreement presented by McPherson County.
Motion by Hewgley, seconded by Deterding to set May 8, 2017 at 10:00 A.M. to receive bids for a card access control system for Lincoln County. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

The Lincoln County Board of Commissioners reconvened at 2:03 P.M. for
a Joint Meeting of the Dawson County, Frontier County and Lincoln County Commissioners
The public hearing was held Monday, April 10, 2017, at the Farnam Senior Center, located at 214 Main Street, Farnam, Nebraska on the circulated petition to form the Farnam Cemetery District in the counties of Dawson County, Frontier County and Lincoln County. The circulated petition proposed to form the Farnam Cemetery District in order to continue financing the maintenance of local cemeteries located in all three counties for those residents whose family and friends are buried in such cemeteries. At the public hearing the legal description of the actual cemetery district will be proposed as will the levy setting out the estimated cost to tax payers in all three counties in order to maintain the local cemeteries. Proposals may be submitted for the exclusion of land from the cemetery district or the inclusion of land in the proposed cemetery district.
Present: Commissioners PJ Jacobson, Bill Stewart, Dean Kugler, Dennis Rickertsen, Everett Hagan, County Clerk Karla Zlatkovsky and Deputy County Attorney Jocelyn Brasher. Lincoln County Commissioners Joseph Hewgley, Bill Henry, Duane Deterding, County Clerk Rebecca Rossell and Deputy County Attorney Joe Wright. Frontier County Commissioners Kevin Owens, J.R. Houser, Steven Hall and County Clerk Darla Walther. Notice of the joint meeting was given in advance, thereof by publication in the Lexington Clipper-Herald, The North Platte Telegraph and the Frontier County Enterprise, the designated method for giving notice. Availability of the Agenda was communicated in advance notice. The proceedings hereafter shown were taken while the convened joint meeting was open to the attendance of the public. All items presented and discussed on the Agenda were available for public inspection. The Pledge of Allegiance was recited.
The joint meeting was called to order at 2:04 p.m. by Commissioner Steven Hall, Frontier County Chairman. Hall informed the public that the Open Meetings Act is posted on the bulletin board on the north wall. At 2:08 p.m., Chairman Hall opened the public hearing regarding a circulated petition to form the Farnam Cemetery District. Brian Davis, Village of Farnam Attorney explained boundaries of the proposed cemetery. Betty Hoppe-Stevens, a resident taxpayer, proposed to exclude 9 sections, sections 24, 25, 26, 27, 28, 29, 34, 35 & 36 from the proposed district boundaries. The public hearing was closed at 2:47 p.m.
Motion was made by Commissioner Hewgley and seconded by Commissioner Deterding to accept the resident taxpayer proposal by Betty Hoppe-Stevens to remove the 9 sections, 24, 25, 26, 27, 28, 29, 34, 35, and 36, from the proposed cemetery district. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none. Motion carried.
Motion was made by Commissioner Deterding and seconded by Commissioner Hewgley that the formation of the proposed district would promote public health, convenience, or welfare, shall order such changes in the boundaries of such proposed district or of the areas into which such proposed district is to be divided as it shall deem proper. The county board shall thereupon designate May 15, 2017 at 2:00 p.m. at the Farnam Senior Center in Farnam, Nebraska to complete the organization thereof. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none. Motion carried.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on April 7, 2017; and was also emailed to the media on April 7, 2017.
The agenda for the meetings to be held on Monday, April 17, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
