Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Henry offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on April 17, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the surveillance system upgrade with Hinton’s Lock & Alarm in the amount of $17,373.04. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-10 for Federal Aid Project HRRR-56(37) – Installation of Advanced Railroad Pavement Markings. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the right of way permit submitted by Dawson Public Power District. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign an agreement with Capital City Concepts, LLC, to conduct a wage and benefit comparability study for the Lincoln County Sheriff’s Office in the amount of $9,500 plus expenses. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:17 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on April 17, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the withdrawal of tax status valuation protest number 2017-VP-45 submitted by Central Nebraska Public Power District. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:23 A.M. and the Lincoln County Board of Commissioners reconvened.

 

The following informal quotes were received for the purchase of 13 AED units for Lincoln County: HeartSmart – $10,335; CPR Savers – $12,025; AED Superstore – $12,113.40; American AED – $12. 987; and AEDGrant. com – $12,695.28.

 

Motion by Hewgley, seconded by Deterding to accept the quote of HeartSmart.com in the amount of $10,335 for 13 AED units. Upon roll call vote Deterding,  Hewgley and Henry voted “aye”.  Nays, none.

 

A public hearing was opened at 9:31 A.M. on the application submitted by Pals Brewing Company LLC dba Pals Brewing Company for a Class K (catering license) to be added to the Class I Liquor License.

 

Chuck McCarty questioned the difference was between the Class I and Class K liquor licenses and expressed concern about the number of liquor licenses in the county.

 

The public hearing was closed at 9:38 A.M.

 

Motion by Hewgley, seconded by Deterding to adopt Resolution No. 2017-11 recommending approval of the application submitted by Pal’s Brewing Company LLC dba Pal’s Brewing Company for a Class K (catering) added to the Class I Liquor License. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the 2017-2019 VOCA (Victim/Witness) grant application to be submitted to the Nebraska Crime Commission. Upon roll call voted Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 10:00 A.M. and the Lincoln County Board of Equalization reconvened.

 

Motion by Hewgley, seconded by Henry upon the following tax status protests. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

Motion by Hewgley, seconded by Deterding to go into closed session at 11:30 A.M. concerning a strategy session regarding pending litigations and to protect the attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Hewgley, seconded by Deterding to go into open session at 11:57 A.M. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to appoint Chairman Henry of the Lincoln County Board of Equalization to speak on behalf of the Board’s position during the State of Nebraska Equalization Show Cause Hearing regarding the Lincoln County Assessor’s certified 2017 Agricultural Land Values, in particular the grassland values in Market Areas 2 & 3. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 12:00 P.M. and the Lincoln County Board of Commissioners reconvened.

Advance notice and the agenda for the April 24, 2017 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on April 21, 2017; and was also emailed to the media on April 21, 2017.

 

The agenda for the meetings to be held on Monday, May 1, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
