Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Henry offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 31, 2017.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to receive and order filed the treasurer’s receipts.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the fee reports submitted by the County Sheriff & County Clerk.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the reappointment of Deputy County Clerk, Terry Heessel, to the Lincoln County Safety Committee for a three year term.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-19 directing the County Treasurer to issue tax sale certificates to Lincoln County on those parcels which are two (2) years delinquent on real estate taxes or special assessments.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the special designated liquor permit submitted by Sculleys LLC for a reception to be held on August 26, 2017 at the Lincoln County Fairgrounds.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Sue Fleck.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 31, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the certificate of correction or refund submitted by the County Assessor for personal property owned by JC Penneys.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve and authorize the Chairman to sign the certificate of correction or refund submitted by the County Assessor for personal property owned by U-Save.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the motor vehicle tax exemption application submitted by Community Action Partnership of Mid Nebraska as recommended for approval by the County Treasurer.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the notice of valuation changes numbered 2017-38 & 2017-39 as submitted by the County Assessor.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization recessed at 9:27 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-20 authorizing the Chairman to sign an agreement with UPRR and the State of Nebraska Department of Roads for Project No. RRX-56(38) (Maxwell SE UPRR crossing). Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Susan Maline, CPA, presented the 2017/2018 preliminary Lincoln County budget document.

 

Shirley Hubbard discussed Lincoln County property valuations.  County Board explained the property valuation protest process.

 

County Board had a discussion of the application process, obligations, and requirements concerning applying for a grant from the Nebraska Game and Parks Commission under the Recreational Trails Program to construct a recreational non-motorized trail of approximately .6 miles in the Lake Maloney area. This would also include review of documentation and requirements concerning applying for the grant and discussion regarding administrating the grant if received.

 

 

Jim States of the Lake Maloney Home Owners Association, Brent Berklund of TC Engineering and Brian Hope of Nebraska Public Power District appeared to discuss the application process.

 

Jim States commented that he had ordered No motorized vehicle signs to place on the trail.

 

Motion by Hewgley, seconded by Deterding to approve giving authority to the Lincoln County Attorney or her deputies to draft the appropriate documents and negotiate with the appropriate entities so that the application requirements can be met, all subject to the final approval of the County Board.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

Recess at 10:15 A.M. as the Lincoln County Board of Commissioners and reconvene as the Lincoln County Board of Equalization.

 

Motion by Deterding, seconded by Hewgley to go into closed session at 10:16 A.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Chairman Henry restated the motion for the closed session.

 

Motion by Hewgley, seconded by Deterding to go into open session at  10:37 A.M.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Adjourn at 10:39 A.M. as the Lincoln County Board of Equalization and reconvene as the Lincoln County Board of Commissioners.

 

Motion by Hewgley, seconded by Deterding to go into closed session at 10:47 A.M. concerning strategy session with respect to collective bargaining and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Chairman Henry restated the motion for the closed session.

The meeting was adjourned at 11:35 A.M.

 

Advance notice and the agenda for the August 7, 2017 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 4, 2017; and was also emailed to the media on August 4, 2017.

 

The agenda for the meetings to be held on Monday, August 14, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
