Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.  Hewgley absent.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Henry to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 2, 2018. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.   Hewgley absent.

 

Motion by Deterding, seconded by Henry to receive and order filed the fee reports submitted by Clerk of District Court and County Clerk. Upon roll call vote Deterding and Henry voted “aye”.  Nays, none.  Hewgley absent.

 

Commissioner Hewgley arrived at 9:05 A.M.

 

Motion by Hewgley, seconded by Deterding to approve the proposal from Simon’s in the amount of $7,950 to replace the north guard rail on Hall School Road Bridge and authorize the Chairman to sign. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger appeared.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 2, 2018. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the certificates of correction or refund as submitted by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

John Childears of Agri Affiliates appeared on behalf of the Evans brothers to request the

opening of a road in Lincoln County on North River Road, 15 miles northwest of North Platte known to the locals as Newton Lane. He reported that there is no legal access to the property now and attempts to negotiate an access could not be negotiated.  The Evans Ranch estate did not include access to this property. Therefore, they are requesting the county re-open the road. The county would not have to build a road or maintain it.

 

Commissioner Hewgley questioned whether a legal easement could be worked out among the property owners as it would not have be the 66’ requirement for a county road. He did not recall the county re-opening a road after it was vacated but easements have been worked out.

 

Commissioner Henry also stated that this may be an internal problem they want the county to fix.

 

Highway Supt. O’Dell reported that if a road is opened there is a petition process, it would need to be surveyed and would have to meet legal standards for county roads.

 

Mr. Childears replied that there is state statute for land locked property.

 

Deputy County Attorney, Joe Wright, confirmed that isolated roads have a different set of statutes than establishing a road.

 

After further discussion concerning the property, Deputy County Attorney, Joe Wright, told Mr. Childears to come into the County Attorney’s Office and he would give him the Nebraska State Statutes concerning isolated roads.

 

Motion by Deterding, seconded by Hewgley to set the date of January 29, 2018 at 10:00 A.M. to receive bids for motor grader blades for Lincoln County Department of Roads. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Highway Supt., Carla O’Dell, stated that she had done some research on what was needed concerning a request for proposals for the South Buffalo Road Project. An advertised RFP is not needed since no federal funds are being used.  She can request informal proposals and then make a recommendation to the County Board.

 

Motion by Hewgley, seconded by Deterding to approve and authorize Highway Supt., Carla O’Dell, to do the request for proposals for the South Buffalo Road Project as she sees fit. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to adopt Resolution No. 2018-01 setting the salaries for elected officials for the four year term from 2019 to 2023. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The salaries were set for the following:

Advance notice and the agenda for the January 8, 2018 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 5, 2018; and was also emailed to the media on January 5, 2018.

 

The agenda for the meetings to be held on Tuesday, January 16, 2018 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
