Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Henry offered prayer. Deterding called the meeting to order at 9:00 A.M.
Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 3, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Henry, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Henry to receive and order filed in the office of the Lincoln County Clerk the audit report of Lincoln County, NE for fiscal year ending June 30, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Hewgley, seconded by Henry to authorize the Chairman to sign the NE City/County Lottery Annual Report for 10-1-2017 to 9-30-2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
Motion by Henry, seconded by Hewgley to receive and order field the fee reports submitted by the Clerk of District Court, Register of Deeds and County Clerk. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on December 3, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
The Lincoln County Board of Equalization adjourned at 9:16 A.M. and the Lincoln County Board of Commissioners reconvened.
Discussion was held with the North Platte Trails Network about the application process, obligations, and requirements concerning applying for a grant from the NE Game & Parks Commission under the Recreations Trails Program to construct a recreational non-motorized trail (West State Farm Connection Trail).
The committee reported that they had raised the 20% in matching funds needed for the grant since the last time they were on the County Board agenda. They are requesting the county to be the lead agency on the grant application.
Brent Burklund of T.C. Engineering reported that the preliminary trail designation would impact drainage and there would be smaller water shed areas. They would have to look at options to address concerns with these issues.
Commissioner Deterding asked about the width of the trail and how much distance there would be between it and the road.
Judy Pederson from the committee responded that it is 8 ft. wide and would be 6 inches deep. There would be 14 ft. between the edge of the road and the trail.
Commissioner Henry questioned if they had met with landowners in the area and the removal of trees by one land owner.
Judy replied that the committee had several community meetings that land owners attended. The land owner did not have issue with removal of the trees.
Commissioner Hewgley expressed concern about maintenance and/or replacement in the future.
Pederson commented that the City of North Platte does maintenance for part of the trail in that area so they are hoping to extend that to the new portion of the trail. They have not had an issue with replacement of any of the trails so far but they do have a reserve fund but is has not been utilized.
Deputy County Attorney, Joe Wright, reported that the committee may have to purchase liability insurance and have an escrow account with the county.
Carla O’ Dell, Lincoln County Highway Supt., had no issue with the trail as long as the drainage issue can be addressed.
The County Board took no action on the request at this time.
Lincoln County Attorney, Rebecca Harling, stated that Lincoln County has had a juvenile pre-trial diversion program for decades. Nothing has changed with the program. The county just needs to reaffirm that we have the program to make sure we are covered by Nebraska State Statutes
Motion by Hewgley, seconded by Henry to adopt Resolution No. 2018-33 concurring with the Lincoln County Attorney, Rebecca Harling, in the reaffirmation of the establishment of the Juvenile Diversion Program for Lincoln County, Nebraska. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.

Advance notice and the agenda for the December 10, 2018 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 7, 2018; and was also emailed to the media on December 7, 2018.
The agenda for the meetings to be held on Monday, December 17, 2018 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
