Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 11, 2019 with the correction on the portion concerning the certificates of correction or refund by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Woodruff to receive and order filed the fee reports submitted by the County Sheriff & County Treasurer. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to approve and adopt Resolution No. 2019-09 transferring $40,000 from the Misc. General Fund budget to the Commissioners budget to cover the increase in salary from three to five Commissioners. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to approve and authorize the chairman to sign the special designated liquor license submitted by Pals Brewing Company LLC for a corn hole tournament to be held on April 17, 2019 at the Lincoln County Fairgrounds. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Lorie Koertner.

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to approve the motor vehicle tax exemption application submitted by North Platte Baptist Church as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Recessed at 9:25 A.M. as the Lincoln County Board of Equalization and reconvene as the Lincoln County Board of Commissioners.

The following appeared by telephone concerning the tax exemption application on real and personal property submitted by VSL North Platte Estates LLC: Attorneys Bob Lepp and Erin Robak as well as Brian Steward who is the CFO for Vetter Senior Living.
All involved agreed that independent living is not part of this only the assisted living facilities.
Deputy County Attorney, Joe Wright, and County Assessor, Julie Stenger stated that they had an email from VSL indicating that they were still working on the personal property to determine what would be included with the assisted living portion.
Stenger reported that the assisted living portion of the personal property would need to be included in whatever the county board decided.
Robak commented that they had looked at the language in their admission policy that the county was concerned about and that portion has been revised.
Stenger said that if she left the independent living portion of the property it would be approximately 46% of the taxable value and that 54% would be tax exempt. The tax exempt portion would include the assisted living facility and maintenance garage.
Robak asked how the percentages were calculated.
Stenger stated that is was based on the total value of the property and she got the percentages from there.
Robak reported that VSL agrees with how the percentage was figured by the County Assessor.
Motion by Weems, seconded by Henry to go into closed session for deliberation at 10:48 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Hewgley restated the motion for the closed session.
Motion by Weems, seconded by Henry to go into open session at 11:13 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to approve a portion of the tax exemption application submitted by VSL North Platte Estates LLC for the assisted living building and the maintenance building and the personal property associated with the assisted living building and the maintenance building. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 11:16 A.M. and the Lincoln County Board of Commissioners reconvened.

The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
