Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on May 6, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Weems to enter into an agreement with Marcia Trego for protest valuation referee services for 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Weems to receive and order filed the fee reports submitted by the Clerk of District Court, County Clerk, Register of Deeds and County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Equalization meeting held on May 6, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

 

Jerry Feist, UDSA Supervisor and Daniel Penner appeared to answer any questions the Commissioners may have about the wildlife services agreement and give a brief report of last statistics. The new agreement has a 3% increase.

 

Motion by Woodruff, seconded by Johnson to approve and authorize the Chairman to sign a work/financial plan between Lincoln County and USDA for wildlife services from July 1, 2019 to June 30, 2020. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Henry to approve and authorize the Chairman to sign

contract change orders (001 for LCDOR 2019-1 Phase I) and (002 for LCDOR 2019-1

Phase II) with Western Engineering Co. Inc. Upon roll call vote Hewgley, Weems,

Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Johnson to approve the request of Kyle Layman to temporarily close 200 yards of the road off Railroad Street from Wilson Street to Bi-Centennial Street to provide extra parking for a bull riding event from May 22, 2019 through May 26, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Woodruff to go into closed session at 10:08 A.M. regarding deployment of security personnel or devices, and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Johnson, seconded by Henry to go into open session at 10:23 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Henry to go into closed session at 10:30 A.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Chairman Hewgley restated the motion for the closed session

 

Motion by Woodruff, seconded by Henry to go into open session at 12:13 P.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 12:13 P.M. and Commissioner Henry was excused.

 

The Lincoln County Board of Commissioners reconvened at 1:04 P.M.

 

Motion by Woodruff, seconded by Johnson to go into closed session at 1:05 P.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Johnson and Woodruff voted “aye”. Nays, none. Henry absent.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Woodruff, seconded by Johnson to go into open session at 2:10 P.M. Upon roll call vote Hewgley, Weems, Johnson and Woodruff voted “aye”. Nays, none. Henry absent.

 

Motion by Woodruff, seconded by Johnson to forthwith remove Lorie Koertner as Lincoln County Treasurer at 2:11 P.M., pursuant to Nebraska Revised Statute section 23-1603 for neglecting or refusing to render any account or settlement required by law, and failing or neglecting to account for any balance due the state, county, township, school district or any other municipal subdivision or is guilty of any other misconduct in office. Upon roll call vote Hewgley, Weems, Johnson and Woodruff voted “aye”. Nays, none. Henry absent.

 

Motion by Johnson, seconded by Woodruff to appoint Sue Fleck, as of May 13th, 2019 at 2:12 P.M., to perform the duties of the County Treasurer until a successor is elected or appointed and qualified pursuant to Nebraska Revised Statute section 23-1603. Upon roll call vote Hewgley, Weems, Johnson and Woodruff voted “aye”. Nays, none. Henry absent.

 

Chairman Hewgley stated the Lincoln County Deputy Treasurer, Jennifer Hergenrader, is also removed effective immediately per that statute and per our new County Treasurer.

 

Motion by Weems, seconded by Woodruff to request the Nebraska State Auditor to forthwith perform an attestation of the Lincoln County Treasurer’s Office. Upon roll call vote Hewgley, Weems, Johnson and Woodruff voted “aye”. Nays, none. Henry absent.

Advance notice and the agenda for the May 13, 2019 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on May 10, 2019; and was also emailed to the media on May 10, 2019.

 

The agenda for the meetings to be held on Monday, May 20, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
