Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell.  Johnson offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 3, 2019.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Weems to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Johnson to receive and order filed the fee reports submitted by the County Clerk, Clerk of District Court and Register of Deeds.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign the right-of-way permit submitted by Century Link.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Henry to approve the postponement of the bid date for South River Road Construction Project, FEMA Disaster #4225.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Woodruff to approve and authorize the Chairman to sign the right-of-way submitted by Consolidated Companies, Inc.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Henry to accept the Notice of Termination from Thomas County for Veteran’s Office services effective July 1, 2019.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Weems, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 3, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Weems, seconded by Woodruff to approve the appointment of Jeff Boeka to the North Platte/Lincoln County Visitors Bureau Advisory Board to fill the vacancy created by the resignation of Barb Fear for the term to end in 2022.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Pam Mann, Executive Director, of Region II Human Services updated the County Board.

 

Lexie Dillard appeared to discuss the damage to her vehicle that occurred in the county parking lot.

 

Motion by Henry, seconded by Woodruff to take no action on the tort claim filed by Lexie Dillard and to forward the information to Lincoln County’s Insurance carrier for further investigation.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign the contract between The county of Lincoln, Nebraska and Figgins Construction Co., Inc., for Project LCDOR-2019-02.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Chairman Hewgley requested that the letter regarding the hearing continuance served to Lorie Koertner on June 5, 2019, by Jon McNeel of Western Nebraska Investigations be received and marked as “Exhibit 3”.

 

Motion by Woodruff, seconded by Henry to continue the hearing from June 24, 2019, to July 15, 2019, at 10:00 A.M., in regards to determining if the Lincoln County Treasurer, Lorie Koertner, committed misconduct in office under Neb. Rev. Stat. § 23-1603, on or about January 3, 2019, to May 13, 2019.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Henry to continue the matter regarding the possible removal of the Lincoln County Treasurer, Lorie Koertner, under Neb. Rev. Stat. § 23-1603, from June 24, 2019, to July 15, 2019, at 10:00 A.M., but to be held, if needed, after the hearing that determines if the Lincoln County Treasurer, Lorie Koertner, committed misconduct in office under Neb. Rev. Stat. § 23-1603, on or about January 3, 2019, to May 13, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Weems to appoint Chairman Hewgley and Commissioner Woodruff to review the draft attestation report for the County Treasurer’s Office and to make a recommended response (If necessary) for the County Board of Commissioners to consider.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Weems to go into closed session at 10:19 A.M. concerning strategy session regarding pending litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Henry, seconded by Johnson to go into open session at 11:31 A.M.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

The meeting was adjourned at 12:06 P.M.

 

Advance notice and the agenda for the June 10, 2019 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on June 7, 2019; and was also emailed to the media on June 7, 2019.

 

The agenda for the meetings to be held on Monday, June 17, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
