Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Weems offered prayer. Hewgley called the meeting to order at 8:05 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 15, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Henry that the Lincoln County Board of Commissioners affirm the appointment of Shelli Franzen to perform the duties of the Lincoln County Treasurer, as described in Neb. Rev. Stat. §23-1603, until a successor is elected or appointed and qualified. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign the certificates of correction or refund on real property as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign the certificates of correction or refund on personal property as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Johnson to approve to accept the late filing of homestead exemption as submitted by Patricia Johnson. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Weems to approve to accept the late filing of homestead exemption as submitted by Jeannine Rhoades. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization recessed at 9:24 A.M. and the Lincoln County Board of Commissioners reconvened.
Conner Todd appeared to discuss the tort claim he filed for payment of medical bills while in the Detention Center.
Sheriff Kramer can provide documents concerning the medical care that was provided by the Detention Center to Mr. Conner.
Motion by Weems, seconded by Johnson to forward the claim to the County’s insurance carrier for further investigation. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to accept the Maintenance Plan West State Farm Connection Trail – Non-Motorized Trail North Platte, NE. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted ‘aye”. Nays, none
Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign entering The county of Lincoln, in the State of Nebraska, the recipient, into an Escrow Agreement with Mid-Nebraska Community Foundation, the contributor, and Title Services of the Plain, LLC, the escrow agent, for the purpose of the Mid-Nebraska Community Foundation contributing matching funds to the Project known as “West State Farm Connection Trail”, if the County is awarded a grant for said project by the Nebraska Game and Parks Commission and the County accepts said grant. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign entering The county of Lincoln, in the State of Nebraska, into an agreement with Myers Construction for the “Lake Maloney Hiking and Biking Trail, Phase IV”. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to go into closed session at 10:00 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Hewgley restated the motion for the closed session.

The Lincoln County Board of Commissioners recessed at 12:06 P.M. and reconvened at 1:01 P.M. at the Lincoln County Department of Roads (2010 Rodeo Road) to discuss road issues then to do on-site road visits to: 1) Johnson Road from Weaver Heights north to the end: 2) Wagon Trail Road from South River for 1 ½ miles; 3) Miller School Road; and 4) Whispering Hills Road.
Highway Supt., Carla O’Dell, reported that the weather the last seven months has contributed to road issues. The department has re-built some roads this summer and they are starting to catch up.
Tony Armer of Mainelli & Wagner gave a presentation on roller compacted concrete pavement.
L-Tap gave some brief comments on the signage, safety and training offered to the road departments.
Commissioners asked about availability and how the training was conducted.
Carla introduced the Assistant Highway Supt. and three district road foremen.
Brian Glos, Assistant Highway Supt., reported they had discussed with L-Tap the possibility of doing some motor grader training for all the road department employees and bumping it up to this summer instead of waiting until fall.
No action was taken at this work session.
The meeting was adjourned at 5:00 P.M.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July 19, 2019; and was also emailed to the media on July 19, 2019.
The agenda for the meetings to be held on Monday, July 29, 2019 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
