Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Johnson offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 12, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Johnson to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the 2017 VACO grant de-obligation letter. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Woodruff to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Henry to approve and adopt Resolution No. 2019-20 directing the County Treasurer to issue tax sale certificates to Lincoln County on those parcels which are two years delinquent on real estate taxes or special assessments. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign an agreement with Martin J. Troshynski, attorney at law, whereby Mr. Troshynski would provide legal services in criminal matters, juvenile matters under subsections (1), (2), 3(a) and 3(b), mental health hearings, child support contempt, and paternity cases for indigent individuals found by the court to be entitled to representation. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign an agreement with William J. Troshynski, attorney at law, whereby Mr. Troshynski would provide legal series in guardianship and conservatorship matters for indigent individuals found by the court to be entitled to representation. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

 

The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign the special designated liquor license application for a beer sampling/tasting event on September 14, 2019 at Pals Brewing Company for Johnnie Byrd Brewing Company. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Henry to approve and authorize the Chairman to sign the special designated liquor license application for a beer sampling/tasting event on September 14, 2019 at Pals Brewing Company for BDS3C LLC DBA Flyover Brewing Company. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Weems to approve and authorize the Chairman to sign the special designated liquor license application for a beer sampling/tasting event on September 14, 2019 at Pals Brewing Company for Lost Way Brewery. Upon roll call vote Hewgley, Henry, Weems, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the special designated liquor license application for a beer sampling/tasting event on September 14, 2019 at Pals Brewing Company for McFarland Family Farms LLC DBA Mac’s Creek Winery. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.   Nays, none.

 

Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign the special designated liquor license application for a beer sampling/tasting event on September 14, 2019 at Pals Brewing Company for Brewery 719. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye’. Nays, none.

 

Motion by Henry, seconded by Woodruff to approve the reappointment of the following Lincoln County Planning Commission Members for three year terms: Rodney Rayburn, Mitch Moorhead, Linda Hansen and Roger Merritt. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Johnson to approve and adopt Resolution No. 2019-21 an application by Renee M. Piper to vacate Maxwell Lake Estates. The property is located in a TA-1 Transitional Agricultural District located on East Shack Road east of North Platte north of I-80 and is described as a tract of land in Government Lot 4 and accretions thereto in Section 22, Township 13 North, Range 29 West of the 6th P.M., Lincoln County, Nebraska. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

County Board and Leanda Honeywell, a representative from NE Department of Health and Human Services, continued the review of General Assistance and Medical Assistance Program Regulations /Standards for Lincoln County, Nebraska. The next step will be having the board set a date for public hearing on the proposed changes.

 

Motion by Weems, seconded by Woodruff to approve the highway superintendent to pursue hiring an engineer to do a design and hydraulic study on the Ingham bridge replacement project subject to board approval. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Sheriff Kramer stated the detention facility had generated 3.7 million dollars in revenue since 2015 during discussion concerning possible expansion of the facility with an additional pod.

 

Commissioner Henry asked if the detention facility could generate enough revenue to cover the bond payments.

 

Sheriff Kramer responded in the affirmative.

 

Motion by Woodruff, seconded by Henry to approve and authorize the Chairman to sign an underwriting engagement and disclosure letter with D A Davidson for limited tax obligation bonds for detention center expansion. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Weems to go into closed session at 10:45 A.M. concerning strategy session regarding litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Henry, seconded by Weems to go into open session at 11:09 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Johnson to approve entering The county of Lincoln (County) into a settlement agreement regarding a Complaint filed in the United States District Court for the District of Nebraska, Case No. 4:17-cv-03044, against the County. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

County Board conducted a 2019/2020 Lincoln County Budget Work Session. The following offices/departments appeared: Building & Grounds, County Treasurer and County Roads.

Advance notice and the agenda for the August 19, 2019 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 16, 2019; and was also emailed to the media on August 16, 2019.

 

The agenda for the meetings to be held on Monday, August 26, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
