Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Weems offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Weems to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 19, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign the right of way permit submitted by Viaero Fiber Networks LLC. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Henry to receive and order filed the fee report submitted by the County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign Change Order 003 with Western Engineering Co. Inc. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Johnson to approve and authorize the Chairman to sign a service agreement with Eakes for a copier in the Register of Deeds Office. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Woodruff, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 19, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

There were no certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:16 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Henry, seconded by Weems to approve the appointment of Brandon Myers as authorized representative for FEMA Disaster DR-4420 (flooding in March, 2019) and authorize the Chairman to sign the documents. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Johnson, seconded by Henry to approve and adopt Resolution No. 2019-22

by Lincoln County determining the final allocation of levy for political subdivisions under

the county levy limit. Upon roll call vote Hewgley, Weems, Henry, Johnson and

Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Weems to approve and authorize the Chairman to

sign the special designated liquor license submitted by La Casa Del Rios LLC for a

reception to be held at Creekside Event Center on September 14, 2019. Upon roll call

vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Henry to declare the used tires stored at the Lincoln

County Roads Department to be surplus personal property, which is obsolete or

unusable by the County. Upon roll call vote Hewgley, Weems, Henry, Johnson and

Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Johnson to place zero value on the surplus property (stored used tires), which is obsolete or unusable by the County. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Weems to dispose of the surplus property (stored used tires), which have no value, at the City of North Platte grant collection site on October 3, 4 & 5, 2019 for no charge. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Woodruff to approve and authorize the Chairman to sign the supplemental agreement letter with Mainelli Wagner & Associates, Inc. for 2015 FEMA Disaster 4225 West South River Road Construction Project in the amount of $7,457.00. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

The following bid for vehicles for the Lincoln County Sheriff’s Office was received:

 

Janssen Chrysler Dodge – Three 2019 Ram Special Service trucks – $29,932 w/three vehicles traded in.

 

Motion by Weems, seconded by Woodruff to accept the bid of Janssen Chrysler Dodge for three trucks in the amount of $29,932 w/three vehicles traded in. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Deputy County Attorney Joe Wright reported there were three options to fill the County Treasurer’s position: appointment, election or taking applications for appointment.

 

Commissioner Henry stated he preferred appointment over special election.

 

Commissioner Weems had several questions about election and timing of the deadlines. He stated he felt the board met the challenge in serving in the public’s interest.

 

A motion was made by Henry and seconded by Woodruff to go with the appointment process instead of election. Discussion was held on the motion but no roll call was taken.

 

An amendment was offered by Henry to the motion to insert the name of Shelli Franzen to fill out the remaining term of Lincoln County Treasurer.

 

A motion was made by Henry and seconded by Woodruff to adopt the amendment to the motion to insert the name of Shelli Franzen to fill out the remaining term of Lincoln County Treasurer. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Henry, seconded by Woodruff to appoint Shelli Franzen, a resident of Lincoln County, Nebraska, as the Lincoln County Treasurer for the remaining term of the Office, which therefore meets the requirements under Neb. Rev. Stat. §23-1603 in appointing a qualified successor to the office. Upon roll call vote Hewgley, Henry, Johnson and Woodruff voted “aye”. Weems voted “nay”. Motion carried.

 

A presentation was given by Andy Forney of DA Davidson for Limited Tax Obligation Bonds for the possible detention center expansion project.

 

Motion by Weems, seconded by Johnson directing the Nebraska Department of Health

& Human Services and the Lincoln County Attorney’s Office to draft a proposal

amending the 2005 Amendment to the Lincoln County General Assistance and Medical

Assistance Program Regulations/Standards and amendments thereto, as

recommended to the Lincoln County Board of Commissioners on August 19, 2019.

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays,

none.

 

Motion by Henry, seconded by Weems to approve exceeding the budget limit by an

additional one percent (1%) for the 2019/2020 fiscal year Lincoln County, NE budget.

Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays,

none.

 

Motion by Weems, seconded by Johnson to set September 9, 2019 at 10:00 A.M. for

public hearing to receive comments on the proposed 2019/2020 fiscal year Lincoln

County, NE budget. Upon roll call vote Hewgley, Weems, Henry, Johnson and

Woodruff voted “aye”. Nays, none.

 

Motion by Weems, seconded by Johnson to set September 9, 2019 at 10:15 A.M. for public hearing for the purpose of receiving comments relating to setting the final tax request at a different amount than the prior year. Upon roll call vote Hewgley, Weems,

Henry, Johnson and Woodruff voted “aye”. Nays, none.

County Board conducted a 2019/2020 Lincoln County Budget Work Session.

Advance notice and the agenda for the August 26, 2019 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on August 23, 2019; and was also emailed to the media on August 23, 2019.

 

The agenda for the meetings to be held on Tuesday, September 3, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
