Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Johnson offered prayer. Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Henry, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 21, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Woodruff to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to approve and adopt Resolution No. 2019-34 for withdrawal of securities pledged to the Lincoln County Clerk by NebraskaLand National Bank. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The right of way applications submitted by Hershey Cooperative Telephone Company was tabled until the next board meeting to obtain additional information.
Motion by Weems, seconded by Johnson to approve and authorize the Chairman to sign Change Order #4 with Western Engineering Company for 2019 overlay projects. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Johnson, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on October 21, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Henry to approve notice of valuation change number 2019-45 as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.
Discuss and consider authorizing the Chairman to sign two Nebraska Office of Highway
Safety enforcement grants for the Lincoln County Sheriff’s Office. Corporal Tom
Courter stated the two grant applications are the Click It or Ticket Campaign which runs
from November 27, 2019 to December 1, 2019 and the You Drink, You Drive, You
Lose Campaign which runs the first two weeks in December.
Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign
both Nebraska Office of Highway Safety enforcement grants for the Lincoln County
Sheriff’s Office. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff
voted “aye”. Nays, none.
Discuss and consider authorizing the Chairman to sign Change Order No. 1 for the
Lake Maloney Hike and Bike Trail Phase IV which was to remove and replace a culvert
In the amount of $5,080.19
Motion by Weems, seconded by Johnson to approve and authorize the Chairman to
sign Change Order No. 1 for the Lake Maloney Hike and Bike Trail Phase IV. Upon roll
call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to accept the bid from DTI Trucks of Colorado for a 2002 Ford F550 in the amount of $23,750 for a service truck for the Lincoln County Department of Roads. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to set November 18, 2019 at 10:00 A.M. to accept bids for the South River Road Re-Construction Project. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to go into closed session at 10:03 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Hewgley restated the motion for the closed session.
Motion by Henry, seconded by Woodruff to go into open session at 10:15 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on October 25, 2019; and was also emailed to the media on October 25, 2019.
The agenda for the meetings to be held on Monday, November 4, 2019 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
