Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Jerry Woodruff and County Clerk, Rebecca Rossell.  Commissioner Johnson was absent. Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on October 28, 2019. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Woodruff, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Weems, seconded by Woodruff to approve authorizing the Chairman to sign three right of way permits for Hershey Cooperative Telephone. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Henry, seconded by Weems to approve authorizing the Chairman to sign the 2019 audit representation letter. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Weems, seconded by Henry to approve authorizing the Chairman to sign the response letter to the 2019 audit comments and recommendations. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Weems, seconded by Woodruff to approve reappointment of the following individuals to the Security Committee for 3 year terms starting November, 2019: Jerome Kramer – Sheriff’s Office; Booker Boyer – Building and Grounds; Brandon Myers – Emergency Management; Darla Morris – County Employee; and Les Green – At Large. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Henry, seconded by Weems to approve authorizing the Chairman to sign the Amendment to Contract with Western Engineering Company Inc. for the 2019 overlay projects. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Henry, seconded by Weems to approve and adopt Resolution No. 2019-35 authorizing the Chairman to sign the 2019 Year End Certification of County Highway Supt. Form. Upon roll call vote Hewgley, Weems, Henry, and Woodruff voted “aye”. Nays, none. Johnson absent.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Shelli Franzen.

Motion by Henry, seconded by Weems to approve the motor vehicle tax exemption applications submitted by West Central District Health & Bethel Evangelical Free Church as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Weems, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by First Church of the Nazarene as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Woodruff, seconded by Weems to approve the motor vehicle tax exemption application submitted by the Salvation Army as recommended for approval by the County Treasurer. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

Motion by Henry, seconded by Weems to adopt Resolution No. 2019-36 correcting the 2019 tax levy for Wallace Rural Fire District from .030000 to .025000. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

The Lincoln County Board of Equalization adjourned at 9:27 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Stuart Simpson representing North Platte Public Schools and Larry Bauman, North Platte Public Schools legal counsel, appeared to discuss the tort claim filed by Stuart Simpson concerning the distribution of the schools funds from the County Treasurer earlier this year. He stated all the details should be in the tort claim.

 

Commissioner Henry commented he was surprised at the dollar amount requested.

 

Simpson and Bauman explained there is a statutory process that must be followed for line of credit or tax anticipation notes. There is interest, placement and legal fees involved in the process.

 

Motion by Weems, seconded by Woodruff to forward the tort claim submitted by Stuart L. Simpson, Executive Director of Finance, Facilities and Operations of North Platte Public Schools to the County’s insurance carrier for further investigation. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Lisa Burke, Executive Director, explained the 2019 Visitor Bureau Improvement Grant Funding Requests made by the North Platte/Lincoln County Visitors Bureau Advisory Board. They recommended the following: North Platte American Legion Baseball – $10,000 for the backstop project; Buffalo Bill Kiwanis – $2,500 for additional playground equipment in Iron Horse Park; North Platte Community Playhouse – $6,550 for costs of replacing the aisle lighting and the stage floor repair and repainting; Sutherland Anchor Memorial Park – $1,000 for the Anchor Memorial Park project; and Lincoln County Historical Museum – $14,863 for the archives project at the museum.

 

Motion by Woodruff, seconded by Weems to approve the 2019 Visitors Bureau Improvement Grant Funding Requests made by the North Platte/Lincoln County Visitors Bureau Advisory Board as presented. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

The following bids were received for a new/used dozer for Lincoln County Department of Roads: 1) Murphy Tractor & Equipment Co. – Bid 1 – $153,250 Net for a 2017 Deere with 707 hours; Bid 2 – $143,500 Net for a 2013 Deere with 3080 hours. 2) NMC – Bid 1 – $121, 000 Net for a 2012 CAT with 5,823 hours; Bid 2 – 143,500 Net for a 2014 Cat with 3,156 hours.

 

Motion by Weems, seconded by Henry to table acceptance of bid for the dozer until the November 12, 2019 Commissioner’s meeting. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Motion by Henry, seconded by Woodruff to authorize the Chairman to sign a letter with Mainelli Wagner & Associates, Inc. for Birdwood Avenue Routine Bridge Inspection. Upon roll call vote Hewgley, Weems, Henry and Woodruff voted “aye”. Nays, none. Johnson absent.

 

Ken Main of the Sutherland Village Board appeared to discuss an interlocal agreement with the Village of Sutherland for public library services. The prior agreement with the village for library services was from 2012 to 2017. A payment was made to the village in error last year as a new contract had not been signed but an estimated dollar amount had been put in the county budget. The County Clerk advised she did not put any dollars into this line item in the budget for this fiscal year.

 

Mr. Main stated he would change the dates in the contract to begin in 2021 and would come back to the County Board in the future for consideration.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 1, 2019; and was also emailed to the media on November 1, 2019.

 

The agenda for the meetings to be held on Tuesday, November 12, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
