Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and Deputy County Clerk, Terry Heessel.   Henry offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 4, 2019.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Weems to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Weems to approve fee reports submitted by County Clerk, Clerk of District Court, County Sheriff and Register of Deeds.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Woodruff to approve authorizing the Chairman to sign the right of way application submitted by Consolidated Companies Inc.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none. .

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Woodruff, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 4, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none

 

No certificates of correction or refund as submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:16 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Weems, seconded by Woodruff to approve entering The county of Lincoln, Nebraska, into an acquisition contract with CHAR-LONG-MAR, LIMITED PARTNERSHIP, to acquire a permanent easement in approximately 5.14 acres, located on the North half ( ½ ) of Section 7, Township 13 North, Range 30 West of the 6th P.M., Lincoln County, Nebraska, for the purpose of rebuilding a section of the West South River Road and authorize the Chairman to sign on behalf of the County board.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Chairman Hewgley excused himself from participation in the jail expansion project as he may have a potential conflict of interest.

 

Motion by Weems, seconded by Woodruff to approve entering The county of Lincoln, Nebraska, into an agreement with T.C. Engineering, Incorporated, to be the County’s representative in agreement with TreanorHL, Inc. regarding jail expansion and other modifications to the Lincoln County Detention Center and authorize the Vice-Chairman to sign on behalf of the County Board.  Upon roll call vote Weems, Johnson, Woodruff and Henry voted “aye”.  Nays, none.  Hewgley is absent from this vote.  Motion carried.

 

Motion by Weems, seconded by Woodruff to table the consideration of the agreement with TreanorHL, Inc. for professional architectural services regarding the Lincoln County Jail until November 18, 2019.  Upon roll call vote Weems, Johnson, Woodruff and Henry voted “aye”.  Nays, none.  Hewgley is absent from this vote.  Motion carried.

 

Judy Clark, Lincoln County Planning Director, appeared

 

Motion by Woodruff, seconded by Johnson to approve the application by Jason and Stephanie Lundvall for Lundvall Administrative Subdivision located at 36798 West Medicine Road.  The subdivision will separate a 3 acre residential home site from the remaining parcel in A-1 Agricultural District and described as part of the NE ¼ and Part of the NW ¼ of Section 4, Township 9 North, Range 34 West of the 6th P.M., Lincoln County NE.  Upon roll call vote Hewgley, Henry, Weems, Johnson and Woodruff voted “aye”.  Nays, none.

 

Brandon Myers, director of Region 51 Emergency Management, gave the quarterly report for the department.

 

Carla O’Dell, County Roads Superintendent as well as Brian Glos, Assistant County Roads Superintendent appeared.

 

Received the following bids for 3 used motor graders for the Lincoln County Department of Roads:: 1) Murphy Tractor & Equipment Co. – Bid 1 – 2016 Deer 772G $192,500 List; Bid 2 – 2013 Deer 772G $164,500 List, Bid 3 –2013 Deer 672G 154,950 List, Bid 4 –2013 Deer 770G 134,500 List, Bid 5 –2012 Deer 770G 147,534 List, Bid 6 –2011 Deer 770G 144,500 List, Trade amounts 38,000 for 770 CH 1-20, 15,000 for 770D 1-9 and 35,000 for a 770CH 1-2, additional options are Rylin 10’ V Plow 8900+frt (3 or more 8300+frt) and rear Ripper 10,500.   2) NMC – Bid 1 -2014 CAT 12M2 $173, 000 List; Bid 2 – 2013 CAT 12M2 157,500 List, Bid 3 – 2014 CAT 12M2 149,000 List, Bid 4 – 2015 CAT 12M3 AWD 197,000, Trade amounts 32,325 for 770 CH 1-20, 10,000 for 770D 1-9 and 32,500 for 770-CH 1-20, additional option V Plow 9,690.  Bid acceptance was tabled until November 18, 2019.

 

Received the following bids for 1 used tractor for the Lincoln County Depart of Roads: 1) Plains Equipment Group – 2016 John Deer 6155R 98,000; 2) Miller Repair- 2016 McCormick X7.680 120,995.00; 3) Titan Machinery – Bid 1 –  2007 Case IH 180 Puma 62,000, Bid – 2  2019 Case IH 185Puma 154,000.  Bid acceptance was tabled until November 18, 2019.

 

Received the following bids for 1 new disk for the Lincoln County Department of Roads:  1) Titan Machinery –  New Rome/TAW-16 25,900; 2) NMC – 2020 Rome/TAW-16 24,820.

 

Motion by Weems, seconded by Henry to accept bid from NMC on a 2020 Rome/TAW-16 disk  in the amount of $24,820.  Upon roll call vote Hewgley, Henry, Weems, Johnson and Woodruff voted “aye”.  Nays, none

 

Motion by Henry, seconded by Weems to accept the bid for a 2014 CAT D6N XL dozer from NMC for the net amount of $143,500 with trade.  Upon roll call vote Hewgley, Henry, Weems, Johnson and Woodruff Voted “aye”.  Nays, none.

 

Approved the claims as presented for payment.

 

Hear concerns from Elected Officials, Department Heads and their representative.

 

The meeting was adjourned at 11:00 A.M.

 

Advance notice and the agenda for the November 12, 2019 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 8, 2019; and was also emailed to the media on November 8, 2019.

 

The agenda for the meetings to be held on Monday, November 18, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
