Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Johnson, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on November 12, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to receive and order filed in the Office of the Lincoln County Clerk the audit report of Lincoln County, Nebraska for the fiscal year ending June 30, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to adopt Resolution No. 2019-37 ordering the Lincoln County Attorney to foreclose an “F” Tax Sale Certificate issued by the Lincoln County Treasurer. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.
Motion by Henry, seconded by Weems to approve the minutes regarding the Lincoln County Board of Equalization meeting held on November 12, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
No certificates of correction or refund submitted by the County Assessor.
The Lincoln County Board of Equalization adjourned at 9:16 A.M. and the Lincoln County Board of Commissioners reconvened.
Motion by Weems, seconded by Johnson to approve the aerial operations program agreement with USDA Wildlife Services omitting the non-federal recipients language and authorizing the Chairman to sign. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Hewgley excused himself from participation in the jail expansion project as he may have a potential conflict of interest.
Joe Hewgley, Architect, explained that the preliminary figures for the jail project was 4.3 million dollars for construction costs. Other possible costs would be contingency, engineering fees, and a person to do construction inspections. He would estimate this person to be paid at $40.00 per hour. It was decided by the county to take the additional funds from the inheritance fund.
Commissioner Woodruff asked if there was a construction inspector hired on the initial jail project.
Joe Hewgley, replied that Willis Roethemeyer was a Commissioner at that time and was the contact person representing the board.
Woodruff then questioned if we should have someone to do inspections for this project.
Hewgley responded in the affirmative.
Woodruff then asked how the construction inspector was paid.
Tammy White, Board Assistant, stated that this person was paid $25 an hour.
County Clerk, Rebecca Rossell, informed them that on the initial jail project this person was on the county payroll as a county employee.
Commissioner Weems commented that he had two concerns. He wants the project to be what the Sheriff needs it to be, but he would like to see it reduced a little in cost. His other concern is dipping into the inheritance funds.
Commissioner Woodruff asked what the supplemental costs and services are in the contract.
Joe Hewgley answered they are listed in a box table in the contract.
County Board then called Dan Rowe of TreanorHL, Inc. to ask additional questions.
Commissioner Weems reported that Section 11.1 had 10% AE fees but the cost summary estimates shows 9.5% for those fees.
Dan Rowe commented that the estimated cost is $325 per square foot. Material has stabilized but labor is more difficult to predict. The county’s biggest discussion will be the quality of work for security.
Woodruff asked if Rowe had taken into account that the exterior brick is already purchased which would give the county some cost savings.
Rowe replied that he had not taken the construction price of the brick off the estimate but would only be a $10,000 to $15,000 cost reduction. He indicated that he felt he could work with the 9.5% AE fees.
Motion by Weems, seconded by Woodruff to approve The county of Lincoln, Nebraska, to enter into an agreement with TreanorHL, Inc. for professional architectural services regarding an addition to the Lincoln County Jail located at the corner of 3rd & Jeffers, North Platte, Nebraska, and comprising approximately 52 beds in approximately 8,500 square feet. Together with a storage room addition of 800 square feet and minor interior modifications and authorize the Vice-Chairman to sign. Upon roll call vote Henry, Weems, Johnson and Woodruff voted “aye”. Nays, none. Hewgley is absent from this vote.
The following bids were received on South River Road Re-Construction Project: 1) Myers Construction Inc. $307,450.63; 2) BSB Construction $258,899.98; 3) Adams Construction Co. $171,086.77; 4) Storer Land Development Inc. $361,709.16.
Motion by Johnson, seconded by Weems to accept the low bid from Adams Construction Co. in the amount of $171,086.77. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Henry to accept bid # 1, 2 & 4 from NMC on 3 CAT motor graders in the amount of $422,175.00. Upon roll call vote Hewgley, Henry, Johnson and Woodruff voted “aye”. Weems voted “nay”. Motion carried.
Motion by Henry, seconded by Weems to accept the bid for a 2007 Case IH Puma 180 from Titan Machinery in the amount of $62,000.00. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to refer a proposed acquisition to and receive from the Lincoln County Planning Commission regarding the conformity of the proposed acquisition comprehensive planning for the area submitted by McWha Industries Inc. that is acquiring a conservation easement on real property owned by McWha Industries Inc., located in Section 2; Township 11 North, Range 26 West of the 6th P.M., Lincoln County, NE. . Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Johnson to acknowledge receiving from Nebraska Department of Health & Human Services and the Lincoln County Attorney’s Office a proposal amending the 2005 Amendment to the Lincoln County General Assistance and Medical Assistance Program Regulations/Standards and all amendments thereto. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Woodruff, seconded by Weems to set the date of December 9, 2019 at 9:30 AM for a public hearing on the proposal amending the 2005 Amendment to the Lincoln County General Assistance and Medical Assistance Program Regulations/Standards and all amendments thereto. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Approved the claims as presented for payment.
The meeting was adjourned at 12:15 P.M.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on November 15 2019; and was also emailed to the media on November 15, 2019.
