Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell. Henry offered prayer. Hewgley called the meeting to order at 9:00 A.M.
Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.
Motion by Woodruff, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 9, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Weems to cancel the December 30, 2019 County Board of Commissioners and County Board of Equalization meetings. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to authorize the Clerk of District Court to electronically sign the sub-award agreement between NE DHHS and Lincoln County on behalf of the County for child support enforcement services. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Johnson, seconded by Henry to receive and order filed the fee reports submitted by the Clerk of District Court and County Sheriff. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Motion by Johnson, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on December 9, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve and authorize the Chairman to sign the certificates of correction and refund on homestead exemptions as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction and refund on real estate as submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.
Shannon Vanderheiden of West Central District Health Department and Jonathan Figliomeni with the State of Nebraska, who is an opioid abuse prevention program coordinator, made a presentation concerning a toxicology testing program.
The Lincoln County Board of Commissioners received written comments from the Lincoln County Planning Commission on the proposed conservation easement on property owned by McWha Industries, Inc.
Commissioner Weems asked why two of the planning commission members voted against the conservation easement.
Judy Clark, Planning Director, responded that they don’t like that these conservation easements dictate what should be done forever with this land.
Motion by Weems, seconded by Woodruff to approve the Conservation Easement on proposed acquisition by Wetland America Trust, Inc. regarding conservation easement on property owned by McWha Industries, Inc., which is approximately 257.13 acres described as a tract of land being that part of the accretion ground surveyed by Bonita Edwards on December 30, 2008, all located in Section 2, Township 11 North, Range 26 Wet of the 6th P.M., Lincoln County, Nebraska. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Woodruff to approve and adopt Resolution No. 2019-38, which (1) adopts the 2020 AMENDMENT TO THE LINCOLN COUNTY GENERAL ASSISTANCE AND MEDICAL ASSISTANCE PROGRAM REGULATIONS/STANDARDS that go in effect on January 1, 2020; and (2) gives authority to the Chairman of this Board to enter this Board into a contract, titled – “AMENDMENT TO CONTRACT AMENDMENT,” with the Nebraska Department of Health and Human Services. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Weems, seconded by Johnson to approve that this Board again adopt Resolution No. 2019-38 in regards to giving authority to the Chairman of this Board to enter this Board into a contract, titled – “AMENDMENT TO CONTRACT AMENDMENT,” with the Nebraska Department of Health and Human Services, which adopts the 2020 AMENDMENT TO THE LINCOLN COUNTY GENERAL ASSISTANCE AND MEDICAL ASSISTANCE PROGRAM REGULATIONS/STANDARDS. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Motion by Henry, seconded by Johnson to approve going into closed session at 10:30 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.
Chairman Hewgley restated the motion for the closed session.
Motion by Henry, seconded by Woodruff to go into open session at 10:47 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 13, 2019; and was also emailed to the media on December 13, 2019.
The agenda for the meetings to be held on Monday, December 23, 2019 will be kept
continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.
