Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell.  Hewgley offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Johnson, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on December 16, 2019.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Johnson to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Woodruff to receive and order filed the fee report submitted by the County Sheriff.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Weems to approve and authorize the Chairman to sign the right of way application submitted by NebraskaLink Holdings.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

Deputy County Assessor, Pat Collins appeared.

 

Motion by Weems, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Equalization meeting held on December 16, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Discussed tort claim filed by Ryan Baade.  Sheriff Kramer reported that all his belongings were in one place so he would have been missing more than just his jacket.  He also signed for his possessions stating they were all there.

 

Motion by Weems, seconded by Henry to table the tort claim filed by Ryan Baade.   Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Sheriff Kramer stated that Prodigy Solution has been providing the service for video calls/court arraignments. If they get the commissary business they will increase the percentage back to the county for these services.

 

Motion by Johnson, seconded by Henry to approve and authorize the Chairman to sign an agreement with Prodigy Solution for inmate telephone services & trust account software.

 

An amendment was made to the motion.

 

Motion by Henry, seconded by Weems to amend the agreement on Section 4.2 and have the Chairman initial the change. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

On the motion to authorize the Chairman to sign the agreement with Prodigy Solution:  Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Discuss Case No. CI 19-642, The county of Lincoln v. Dale Wiezorek, et al., In the District Court of Lincoln County, Nebraska, regarding any possible conflict of interest by the attorney handling the matter for the County and how to proceed on it.

 

County Board took no action as they seen no reason why there would be a conflict of interest.

 

Hear concerns from Elected Officials, Department Heads and their representative.

 

Approved the following claims as presented for payment with two claims pulled for review:

Advance notice and the agenda for the December 23, 2019 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on December 20, 2019; and was also emailed to the media on December 20, 2019.

 

The agenda for the meetings to be held on Monday, January 6, 2020 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
